The New Jersey Department of Labor and Workforce Development (NJDOL) announced proposed increases in the maximum benefit rates for Workers’ Compensation for the calendar year 2023.

New 2023 Rates
In the new year, the maximum weekly benefit amount for new Workers’ Compensation claims rises to $1,099, from $1065. This represents a 3.2% increase over the 2021 rate.

The maximum benefit rate is set by statute at 75% of the average weekly wages earned by all employees covered by the NJ unemployment compensation law.

How Rates Are Calculated
The maximum benefit rates are recalculated each year based on the statewide average weekly wage.

A public hearing is scheduled for November 5, 2022 on the proposed rate increase. 54 NJR 1684 (September 6, 2022).
