what is the insurance company up to now?
ok so now i have recieved a letter in the mail today stating that they want to suspend my payments because they have no medical evidencein the last 45 days to support ongoing benefits???? since when was i obligated to see a dr every 45 days? they have tried every angle to fight me and lost now they try this? so i see a hearing in my future and will be making a dr apt right away. play the game i guess,

Well, if you want to stay on TTD, you need to continue medical treatment. If you don't, they think your doing better. Kind of simple.

I am Required to See My PM Dr. every 3 Months, and a Report sent to The Ins. Co. for My Employer. You have to stay within the Parameters set by Your State or what the Judge May have Ordered to be able to Retain Your Continued Care and TTD Payments. Were You to See Your Dr. every 45 Days? If not what was the Parameters You Agreed to?
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

the ime stated that i see my dr every 90 days and this is their dr they based this on.i am at mmi and amd to just check in and have my scripts filled,so i dont know where they get grounds to have a hearing because its been 45 days??

here in oklahoma im required by work comp to see the dr no later than 6 weeks after my last appointment which was told to me by my drs office..so they always schedule it correctly

Well, if your at MMI they could very well just stop your TTD checks. Why would they continue? MMI means just that, nothing more that can be done to help you. Plus once again, the IME is not your treating doctor, nor do they treat you.

in nys the fusion i had done with the hardware i have is a state law of a disabilty good or bad results. this came right from the judge. so even if im mmi i still have a disabilty for the rest of my life no matter what. so they have to come to me with some kind of settlement. iam going to school in the fall and my question is do jusdges like to see that and will they continue my ttd? also does that qualify me for lost income wages where they pay ne 2/3 of my old job? iam trying to get back into the workforce and thats another issue with the ic because i have no job,but because i worked at a mill right from high school for 14 years thats all i know

Blake, there are major differences in Disability, and when one is considered MMI. Surer you have a disability, but that doesn't mean much, when it is said nothing more can be done medically or better said (((MMI))).
The Insurance Company doesn't have to offer a settlement, don't know where you got that one. But, your attorney can try for a settlement. Insurance Carriers can sit on you claim for as long as they wish, unless a settlement process is in the works, meaning your attorney gets the ball rolling. School at your own expense wont get you any TTD checks, and that is how the judge looks at it. If you where allowed to be retrained through a Work Rehab program, through the approval of the Insurance, then yes all that changes then. Your looking for money in all the wrong places... If I was in as much Pain as you claim to be in, I would be seeing a doctor evey week. but you don't see a need for that, so they are cutting you loose from any TTD checks.
