Had 3 IME's
Been injured since 2006, got released on or about April of 2009 by WC. Temporary Disability Payments had stopped. As per my request, my WC Attorney asked for advancement till settlement. No luck withthe advancement.
I finally had 3 IME's scheduled, 1 from my WC Insurance Co. and 2 from my WC Attorney. It's pretty upsetting to hear from of the IME Physician that we have a corrupt lega system. The WC Judge only wants to hear what they want to hear. The 3rd IME, I was evaluated by a physician and a physial therapist. The PT never conducted an exam. He only dictated what was on the opertive report and diagnostic reports. Unfortunatley, my medical records were incomplete and missing approx. 14 surgica procedures. The IME was pretty upsetting, you get to hear over and over my disability. It was upsetting to lye on the exam table and hearing the physician clicking his recorder and examining you. The exam took approx. 1hr 1/2. I felt like a cadaver being examed to hear my injuries and recalling my injuries over and over and over. You think that you have already accepted the fact of your disabilities but just hearing my injuries over and over again was just upsetting. Before seeing the IME Physicians, I waited in the waiting room and overheard 2 gentlemen discussing their injuries. From my understanding to there converstion, they must work wth te Correction Dept., and had enought time put in to receiev full pension benefits. There job descriptions as on states that he has to carry 2 hand cuff and most of his friened and family had adviced him to get out and take the WC Settlement and being unable to return back to work because of the injury sustained. He would seek a new career possibly working as a bartender and collect approx. $70,000.00 frm his pension and collect from WC settlement and SSD. He did not choose to returne back to work and agrevate the injury and resulting him form permanently not being able to work at all. Now I recall a statement made by one of the IME physicians, that the system we have is corrupt. It's also surprising to hear that there are only a few speciality in law that are classified similiar to as being "Board Certified" (Highest Level) and I was surprise to find out that WC Attorney is one of them. I was told by the physician that we are going for 100% disability and the other party can agrue and fight there figures. I also learned that I was responsible for the IME scheduled by my WC Attornty, payable during settlement in the amount of $200 x 2 = $400 and any additional cost of obtaning medical records from hospitals and physician and all this will be deducted duing settlement. I cannot believe how this process takes this long when other lawsuits such as Personal Injury, Medical Malpractice can take a shorter period. I was told that it normally takes approx 3 weeks for the IME report to be received to my WC Attorney. I'm just glad that it's almost over. |

Honey you havent started to wait yet some on here have been at it for 7 or more years...good luck
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

Have had 2 IME doctors with totally different opinions! One of the IME's took a year to provide his report. The insurance companies are looking for us to give up...hang in there and GOOD LUCK. |

Thank you for your response. Just to have a better understanding in regards to the 2 response that I received. Are you represented by legal counsel? Have you been released or have have reached medical maximum improvement? Are you still collecting temporary disability thru wc? In my case, I have reached MMI and my benefits had stopped. No other surgeries required at this point however, since I have hardware place from top to bottom, I am covered for life if any complications arise related to my injury.
Every injury is different. I don't understand how an IME report can take a year to be generated by the physician, unless your medical conditions has changed from the initial exam. I am also confuse to the comment posted that the "insurane company are looking for us to give up". Have your surgeries denied by the wc insurance company? Are you fighting to have the surgery and wc feels that it is not warranted. What does your attorney think about your claim? My injuries speaks for itself, and maybe that's probably the reason why my case is proceding. It's been al Your attorney is your advocate related to your case to be heard in the wc court. It's been a year that I haven't received any temporary benefits. According to my wc Attorney, it normally takes a year. At the present, I had my IME with WC and my WC attorney scheduled me to see a neuropsychiatric MD and an orthopaedic MD. Just waiting for the report and a court date will be scheduled for both parites to agree upon settlement. I'm just confused for the injuried party to be in WC for so long. My case, I had 10 surgeries one year, and another surgery the following year and another surgery the following year. My Regards To ALL and Best Wishes..... |

Welcome to the forum!
I was injured in 2005, bilateral knee injury. I saw the doctor 2 months after the injury for the first time. After 31 months in court due to denials & delays, and 12 doctors, a total knee replacement was approved and done 36 months after the injury. I now have problems with the back due to the altered gait, and carpal tunnel from prolonged use of the cane. After 15 months in court I received the judge's decision last week granting medical treatment for the back & carpal tunnel only to have the insurance company file an appeal two days later. So you see everything does take time. It had been almost 5 years since my injury and due to the games that are played I still have not received medical treatment for much of my injuries. |

Yes, I am represented by an attorney, but he is not responsive and wants me to go with medical set-aside even though the last IME said I am at MMI according to my wrist injury only; he didn't take my neck and back into consideration and said it in his report. According to 14 out of 16 Drs. I have been in need of 2 surgeries for over 10 years and am still fighting the Ins.Co to get them without much help from my lawyer. I am no longer receiving WC benefits because I have exceeded the 520 weeks (10 years). Hope all goes well for you/All! |
