Income Benefits. Do they increase yearly?
I know "Income Benefits"have "caps" - a maximum amout that can be paid based on SAWW or "state average weekly wage".
I have received benifits for 4 years now - based on the cap from 2003 only. Should my weekly benefits have incresed yearly as SAWW increased? My preinjury weekly average was $986 - I currently receive $376 IIB from WC - based on 2003. |

I believe the amount of benifits is based on what the law was at the time of your injury. can you tell us what state you are from.
8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom. |

Hi Nancy and welcome to the forum. If you put your State in your profile, people will be better able to answer you. Every State is different.
On the top of this page, there is a pull down menu, "Info by State". You can educate yourself on the WC laws specific to your state. That is your lifeline to survival in this maze. Edited because I found out EE is from Texas, not California. oops! Let Go, and Let God...... |

to my understanding WC benefits are paid according to your earnings at the time of the injury. There is no cost of living increase with WC.
CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

I'm on the same State as Cap., Pa. and they are based on time of accident injuries. SSDI gives COLA Raises, if you are receiving both. If you've been out since '03, have you applied for SSDI?
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

In most states, BWC benefits are based on your average weekly wage rate for the year prior to your injury and there is no increase or cost of living increase I should say........sorta sucks don't it. At least that is how it is in Ohio

Like everyone else says CA. is the same way. I injuried my foot in Dec. 2006, they raised w/c Jan. 2007 I didn't get the increase even though I didn't really miss any work until they put me on light duty on Feb. 1st. good luck to you RH |
