As I originally stated I hope I am 100% wrong, but I am going to stay with my original thoughts on this. In the Perfect situation w/c should say this was an unprovoked attack, and accept the claim. But with this situation being so far away from the Employee eyes, I believe they are going to take the stance that it was Provoked, and not Pay. I don't think this is fair, I am just looking at reality. Many of us have had claims denied when the accident happened right in front of Management, and they are going to use it being so far away as their out. I really Hope I am 100% wrong, I think if this person who attacked you was jailed at the time you would stand a much Better chance. I see the Employer dancing around this one, being a Driver myself I never knew there were so many dance moves until I saw some of the ones My Employer has used! Again I Hope I'm wrong, Please come back and tell me I am, I will be very Happy to be wrong this time!!!Wink

LImbo, as cruel as it may sound I really WANT you to be wrong as well, and you know how hard that is for me to say about you of all folks Wink. I hope that the witnesses on the scene can disspell any idea that the employer has that the IW provoked the other driver.

I am sure you have seen some of the same things that I have over the years and I can get a pretty clear visual of what happened by the OP's first few posts. I my mind I see this other driver snorting and stomping around waiting for that "a$$hole" rookie driver to show up with HIS @#$#$@# MT, so he can go make some &$$@@%^# money. The longer he sits there waiting the more fired up he was likely to become.

Ritttzz chose to stay within the law and drive only the designated hours he had available. I expect some sawed off dispatcher led the other driver to believe the MT would be delivered hours before Ritttzz was legally due to arrive. Sound familiar to ya Limbo? How many times have you had a dispatcher tell you something you knew was a bold faced lie? How many times has a dispatcher told someone else a bold faced lie that you know of? We both know how upsetting it is to be lied to and it sounds like the driver that punched Rittzz out was at the breaking point.

I have wonder since reading his OP is the reason he couldn't get through to dispatch wasn't because the other driver was on the line with them. Making sure he told his side of it before Rittzz could report the incident. He did the right thing by calling the law and getting those witnesses statments and I expect those two things alone will go a long way in helping hiim establish this as a WC injury. The thing that concerns me is his quitting before filing it and the lenght of time it has been since the incident.

Your take?

I truly understand where you're coming from New Driver!! The reason I set here Disabled Today is because of the Dispatcher I had! Funny Thing though, about 4 mos. after I got Hurt, he failed his urine test (Coke and Crack) and was fired!!! And here I set in a Lifetime of Pain because the right Crew wasn't sent with me that Day!!!Sad
