I was just sitting here wondering about something that is upsetting me still to this day. About 6 months ago I was going to Pain Management and they said that I would need a spinal cord stimulator as that was the last resort. I had used all the treatments, injections, therapy etc. and medications and that is where it left off. Because my PM doctor was requesting a SCS I of course was sent to a IME with the IC doctor. I never was keen on the idea of having a SCS as I own a Tens unit and like the idea that I can put it on and take it off when I want to as opposed to having a machine implanted in me. My husband also gave me all the cons of having one as I would be having surgery , open for infection, scaring of the body etc. I know it is not his body but I felt the same way about it. I read all about it , watched a video etc.

Here is the question. I got a letter from the WC adjuster I have with a result from the ( Idiot) doctor they sent me to that was very heartless etc. He stated that I was an obese, drug addict that he did not see any need for me to have a SCS and that he suggested that I saw a therapist for drug addicts, depressed people etc. I am not on any anti-depressants and agree that many times I am depressed as ANY person would be losing their career of 15 yrs. and all their hobbies because of their pain. As far as medication I take percocets for pain. I have been diagnosed with CRPS. I use to take stronger medication but went to my new primary and asked to be taken off them because I did not like the way they made me feel to loopy etc. I really did not like the way I was walking around in a cloud all day and not functioning.

So now when I got the letter at the bottom it said " due to the results of the IME your case has been closed because it is not work related". NOW HOW ON EARTH AFTER 2 Yrs. and receiveing a award of $7,500.00 and paying for my medication before they stopped after a year and also paying for all my treatments, doctors appointments can they just tell me that I no longer have WC???? I never got a lawyer and court officer or judge ( what ever they call them ) when you go for a hearing for your award gave me the award of that amount because it was a WC injury , how can they just say they are not going to pay for anything anymore?????

I never contacted a lawyer after that letter because I do not want to fight for a SCS cause I do not want one. I also have insurance through my husband where I am seeing a primary doctor that gives me the pain meds and is very good to me and knows of my pain. She would give me a referrel for anything if I wanted it. I am just upset because I have been taking care of this injury on my own and more or less said S&^^(* Them!!!!! Am I entitled to something I am missing here?????? What should I do at this point as I have been paying for my own medicine and that is pretty much it. I travel almost 1 1/2 hours to my doctor that they would also be paying for. How much time do you have to fight this IME result when they decide to drop my case??????

if you want to get back into the workers comp system and have them restart medical coverage you will have to appeal the denial.
New Hampshire has an 18 month time limit on filing after a denial

You can always dispute the IME. How you do this in your State I don't know. But I do know there is a form you would have to fill out. Then send it to the work comp board, and maybe to the IC.

1171, I had thought, just my opinion though, that a injured worker could dispute a IME medical opinion. I see you showed where they can dispute Denial of benefits which also took place place here. I was mainly talking about the IME report. Since in my opinion being called a Durg Addict doesn't constitute a proper IME Exam.

what value is there in disputing an IME report if there is no way to change the decision?

hello, what actually happens when you appeal an ime? i take it is goes to the workcomp commission--who rules on it--wouldnt your attorney tell you to do this if he also felt it was wrong--and yes i do have an attorney might last ime was so far fetched--my husband was in the room with me--this ime even reported in his report things he would of never of seen had they not been video taping my appointment. i just was curious how to go about it how the commission looks at it does it really change anything and what do they do just throw it out if they find it not crediable thanks for any info you guys are great with all the help you give everyone on here--keep up the good work theres so many out there that need you!!
