Think my payments were stopped
I've been on workers comp since March due to a lower lumbar injury. I'm in NY.
First my payments were cut in half because the IME said I could return to sedentary work (but my job does not have sedentary work unless I usurp my GM and take her job). Next, my job sent me paperwork for the Doc to fill out about ADA. I had an MRI done and found that I have Degenerative Disk Disease, but that has nothing to do with my current injury (the right lower lumbar muscle hurts, but not the spine and the Doc said the two were unrelated). He put in the paperwork that I had DDD. I sent it in and I was supposed to receive a check last week but it never came. I have a feeling that my payments were stopped because of it. I do have a WC hearing scheduled for the end of August and I'm calling a lawyer tomorrow for help. I am also calling the WC insurance carrier to find out what is going on. I've been with this company for over 8 years, could my DDD be aggrivated or caused by my job? It is constant heavym lifting, bending and all around activity. |

good luck i was hurt in dec and my payments were stopped in jan i think because my case manager reported i could also do sedentary work with a lot of restrictions. no money and i cant find out why. called wormans comp and they wont talk to me because i have a lawyer, same with insurance. Problem I have is my lawyer wont give me answers either. i have used all my savings and i am still awaiting surgery- cant live with no money so today i am applying with the state and i hav also started filling out application for social security disability. sorry I can't b of help but i wanted you to know you are not alone. You physician is the best one to answer that but I would think that discs could be aggravated by being used to lift heavy things regularly.

Thanks.
I learned a long time ago with WC to get on their butt when my payment is late. But the good thing is that my new case worker is usually on the ball and calls me when there's problems or gets back to me ASAP(she was quite miffed when she took over my case to find that my previous case worker left my case hanging in the breeze for seven weeks and I hadn't even gotten my first check when all she had to do was call my boss to verify the claim). So hopefully I'll get some answers and things straightened out tomorrow. |

Your doctor is the best one to decide whether your back is being aggravated by your job duties but I would think it was.
