Hi All,
Received today a settlement offer of $10,000. with no future medical, to close out my case. My current WC doctor has stated I am at MMI (even though I can barely walk and he wanted to examine my hip and back) and gave me a 20% disability rating on only my left knee.

I am awaiting a ruling on SSDI which I expect will be denied. My lawyer (same as Bummer Knees) says that if I don't accept this offer that it could complicate medicare in the future.

Well I've already turned it down, will not settle unless it's atleast enough to cover a knee replacement (won't happen in the state of Ks). Plus I don't have to settle, not now, not ever. A former co-worker of mine has 5 open work comp cases that she's never settled on. She says that she like the idea that it irks the crap out of them. I don't quite feel that way but at this point I don't have to settle. I still have a bone to pick and frankly I like dragging their sorry behinds into court.

I do realize that some might take offense to my last sentence, so be it. I can hardly walk some days, I can no longer straighten my left leg all the way. My autistic son stated in October that in 6 months I might not be walking. Frankly I see crutches in my future. I go in for an MRI in two weeks that I'm paying for out of my own pocket. I look forward to the report, it just might be interesting. If it came back stating osteomyelitis I wouldn't be one bit surprised.

BB you must do what you think is best for you......if you dont wanna settle then thats your call...we will back you whatever you decide...

And the reason to this Attorney's Maddness is what? I'm starting to have strange thoughts about this attorney you and Bummer are sharing.

You need to know, what will fix the Knee, and Get er Done. Tell your Attorney to get to work on that, and to stop worring about Medicare.

I switched attorneys because my old attorney had frankly given up. I do have a strange feeling about our attorney's thoughts about medicare and other things. But it's only a settlement offer, I don't think he'd refuse to continue my case if I turned down the offer. Frankly that would be stupid, I do believe that most people turn down several offers.

When I settled with future medical in 2007 with future medical the settlement amount was just over $8000. My attorney actually stated that he felt that an offer of $10,000. was pretty good. That did floor me for a second, an offer of just over a thousand more. Don't get me wrong, it's not about the money. I frankly don't care if I ever get any money from my former employer, I just want to be able to walk properly and be without pain. But I also realize that may never happen but I have alot of faith. God has a plan, I just have to be willing to wait it out.

Medicare meds absolutely nothing to me at this time. I just want medical care.

Hi BB,
I feel your frustration, and doubt anyone will take offense at what you have said. It's how you feel.

If you aren't happy with the offer, then decline it. Simple. Your attorney works for YOU. Not the other way around.

I do hope you have a favorable decision from SSDI. Much of the decision depends on your age factor, and your doctor's responses to SSA. It's better to prepare for a denial rather than be surprised at one. That's what the appeal's process is for; and many are denied and many don't appeal.

The Others are absolutely Correct!! My Attorney and I were Talking one Day, (He's Great, Calls Back Quickly, and always Gives Me as Much Time as I Need when We Talk) and were Tossing around Settlement Numbers. Now I have had 3 IME's, 2 FCE's, and Won in Court and I'm the Credible Party with the Credible Dr. His Contention as far as Settlement goes is that All Medical and Legal Issues should be Resolved before Settling. Then You are just looking at what You May need for the Future. You Paid to Have this w/c Insurance, and Your Attorney is Paid by You, so You are in the Drivers Seat! I always Ask My Attorney for His Suggestions, but the Decision made is always Mine, and He acts Upon my Decisions! I want to be fair also, as I Know You do, but They Play soo Many Games with Us it's Very Easy to want Retribution!! Hang in There, and Think Hard before You make any Decisions, I have Turned down an Offer, and My Attorney Agreed I should Have!! Stay Strong!!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

I decided a long time ago that I had only me to worry about in this work cop mess. My WC doc, my lawyer have so many to think and care about. I just need to try and do what is right for me.
