You are correct Bad Boy, my attorney was negligent with my case. At one point a mediation was scheduled and he did not notify me, so neither him, nor I attended & the WC attorney asked the Judge to file an Order to Show Cause. The attorney did not respond to our calls, so my wife wrote the Judge to say we were not properly notified.

I had another surgery and this time a mediation was filed & my attorney did not show up. He called claiming to have a flat tire. He handled my case like it was a joke. My doctor said that due to the insurance carrier's negligence I now have a permanent injury.

My attorney asked to be removed from my case after I called his office complaining about his handling of my case. He sent me this email on 12/23/09 saying he was withdrawing effective that day. On 12/29/09 someone filed a notice of voluntary dismissal of my pre-trial hearing and my final hearing without my knowledge.

I asked my attorney for my file, which he did not send me at first. Only after complaining to the owner of the law firm did he send them. That is when I saw that the WC attorney filed a subpoena for my personel files from an employer that I worked for ten years ago. I was with this company for almost 15 years before moving to Florida (from NJ ) there is my application & get this....random drug tests that were done, which were all negative. My employer started doing random drug tests after I was with them for about 13 years. So, nothing in my file showed anything against me. I am just wondering if I should have been notified first.

I also called the Clerks office today to request copies of motions that were filed, which are conviently missing from the file my attorney sent me & they told me I cannot have them.

I have reached MMI with PI of 15%, but have yet to receive a dime for this. My previous employer has not gotten back to me on taking me back. My boss told me if I did not come back to work within two weeks after my surgery he would replace me. I was out for much longer than that after the WC carriers refusal to approve Physical therapy for almost two months after surgery. My doctor is totally on my side.

I feel like I am being rail-roaded here & don't know who to call. I sent a letter to the Judge handling me case informing her that I was notified of this dismissal and other things discussed here. They put notice of incoming correspondence, but have heard nothing.
