FMLA Question
Hello everyone, I have a question regarding FMLA. I am in Michigan and I used my 12 weeks of FMLA from August 09 to November 09, since November my employer put me on a leave of absence until Feb. now they have sent me more FMLA papers to fill out but the way I read the laws I am only eligible for one 12 week leave in a 12 month period. Is that per calender year or is my employer wrong in giving me the fmla option? I know Fmla protects my job but I believe there are alterior motives behind their actions. I have 2 weeks vacation pay coming Feb. 12, can being on fmla get them out of giving me my vacation pay?
L4 - S1 Fusion with L3-4 Herniations and disc material on the L5 nerve root left and right. |

There is not one way to count the 12 month period. an employer can elect a rolling 12 month or calendar period or others.

You should discuss such issues with your union representative or the employer's benefits handbook. pay issues and the denial of wages can be reported to your local labor commissioner. |

My claim was originally denied. I went on FMLA . I got paid through the denial by way of my vacation, sick and personal days. Kept me going from MAy until Oct. They finally picked my clain up in July so I was without pay for 8 months instead of 14.
God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |
