Work Comp and Unemployment Claim?
I have now been laid off due to lack of work. My claim was denied due to lack of qtrs paid while on work comp? Does anybody know if I have any recourse? It seems I have also been penalized by unemployment for this accident. Heads up for anybody that may have this happen to them. any answers appreciated. No income coming in is damn scary.

you can appeal an unemployment denial but the quarterly threshold is a very firm requirement.
depending on your state laws there maybe some retraining, re-employment or vocational rehabilitation benefits available from workers comp.

Please Check with Your Attorney, or Check Your States w/c Laws, but if You have been Released by w/c and able to Work, and Works not Available, You should Receive Unemployment. Again Please Check, if Your Employer has no Work for You within Your Restrictions, You May also be able to Continue to Receive w/c Payments. My Opinion Only, I would Make a Few Calls to w/c Attorney's, and See what They Say!!Wink

Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!!

In Kansas you have to have qualified quaters in order to collect unemployment.

One can not collect unemployment & work comp at the same time.

Aug 2006 I hired an attorney to reopen my work comp claim.

My attorney advised until the claim was reopened in court to go ahead and file for unemployment. I did collected unemployment until the hearing date to reopen my claim.

I was successful in reopening my claim and notified the unemployment office of the work comp claim.

I had to repay almost $2,000.00 in benefits because I was found disabled by the work comp judge starting the day of my hearing 9/25/07.

Be careful with work comp & unemployment as Kansas is known to be tough with this issue.

I have since learned of several injured workers in Kansas that had to repay money to unemployment.

Sorry, I don't know anything about Kansas. If it was PA, UC would be based on the year before the work injury, but I don't know if Kansas has a similar statute.

Am not receiving work comp now was done with that back in July. Worked July thru November and am now told I have no benefits available? I would guess that while on work comp there is no way for them to pay Unemployment so if laid off later in the same year you are screwed..
