Energy employees compensation
Recently I was approved under the "Energy Employees Occupational Illness Compensation Program Act (EEOICPA)" "Part E". This entitles me to some medical benifits for my illness. (Severe scarring of the lungs(COPD)) There may or may not be some monetary settlement but unknow how much if any. My question is if/when examined by a specialist and if that specialist determines that there is a percentage of disability, even though I have lost no work, would I be able to file a claim for a partial disability under Workers Comp. This is in the state of Ohio. Anyone have any info on something like this. It only took me 26+ years to get them to recognize that my job caused the problem. Feel free to contact me, any help or info would be appreciated. No I have not talked to an attorney. [/size]

From a quick simple look at this Act, (Energy Employees Occupational Illness Compensation Program Act (EEOICPA), is there are a couple sections in it about State Workmens Compensation.

One Section states;
An offset could take place if both Compensations are used.

Another Section States a waiver could be given in respect to the two compensations used.

Then another Section states;
There shall be nothing is a certain section that shall apply to State Workmens Compensation.

So it is going to take a good attorney with knowledge of both Compensation Systems, to give you this Advise.

Thanks for the info. Did some more checking. Since there may or may not be a monetary award, in the event that there was a monetary award, the workers comp would be offset by the award. So in the long run I gain nothing by persuing a WC claim.
