Got hurt, threatened with job if I turn it in
I'm very confused with how to proceed with my situation. I've never been hurt at work before. I only had this job for two weeks before this happened also.

I was being taught how to unload stacks of full milk crates off of pallets using a dolly. Needless to say, it didn't go over well, and I ended up pulling and straining my back muscles and abdomen. At the time, my immediate supervisor was was me, and I felt ok.. So I didn't report it before leaving. When I woke up the next day, moving was almost impossible! I ended up going into work, filing an incident report, and leaving because of the pain. That night it intensified to the point I couldn't take it anymore. I called the store, and asked the assistant manager if it was ok for me to go to the emergency room. She said yes.

The very next day, the store manager calls to 'ask how I'm feeling', but before I could even finish telling him, he over talks me to ask if I'm expecting his company to pay. (Little background info, this company has a 30 day hiring phase, where at the end they can let you go without any reasoning) My first question was, 'if I turn this in, will I be let go at the end of my 30 days?' He told me that it would weigh heavily on whether or not they asked me to stay, then he laughed and said 'but I'm not allowed to really say that'. The entire conversation he was trying to get me to say that I wouldn't turn it in, and the entire time I felt like every sentence should have began with 'if you wish to keep your job'.

The doctors gave me three days to see if I would feel better. On the 4th day I was scheduled back at work, but I was still in a lot of pain. I called my manager to let them know that I was probably going to take another day off, especially since my job was so physically demanding. This lady just was down right mean, telling me how I was inconviencing everyone else and just on and on.

After all this treatment, I called in today to tell them that I was going to go ahead with having their company pay for my injury, and that I would not be returning to work here. The lady I talked to this time told me that the company wouldn't pay because I didn't go to their doctor, even though I was told the night I went that I could go to the emergency room.

Sorry for this being so long, but I just wanted to make sure you had the whole story. My question is, what do I need to do from here? Go ahead dealing with them once I get the bill, or should I go to workmans comp?

Your not going to have a job anyways in the end. So do the right thing, and turn it in. That is the legal way to do this.

Most states have anti-discrimination statutes that prohibit or penalize employers for retaliation. Contact your state comp commission or board.

Hello. What state are you in? I know how physical demanding that type of work involve. When I used to drive southeastern states deliverin/pickup of freash bread from bakery to deports. I earned extra by loading and unloading my trailer. Stackes are 6-1/2 to 7ft. tall. Used tall dolley with arkward handal. Had dropped deck trailer. Certain way to get it up or down. No matter the conplaints. It had to be done. When someone got injuried, the response was always employee fault. No mention of improper training. I would suggest, go back to emergency room, report that it is job related. Fill out necessary paper. Don't quit evanthough you will probadly be let go anyway. Come back to forum to update and someone here will be gladly to assist further. I have rec'd some good advice and suggestion here. Thanks. Izell.
