in april my mother had a filing cabinet fall on her.

went to the E.R, found out her tibia was fractured, shes been on workmans comp since. she had gone to doctors and therapy but the pain remained. after an IME (independant medical evaluation) by the insurance doctor he concluded that my mother also incurred a back injury during the accident.

so my mothers been going to doctor to doctor and has a doctor treating her for both pain management and a ortho specialist. They both have conquered that she needs to have spinal block injections to last for atleast a year and that she will have to go off her plavix (she is a heart patient) during these injections. on top of continuning therapy on both her back and leg. They both have her out, disabled, unable to work until well into January.

Yesterday my mother received a letter from her employer stating that she's been cleared to return back to work by the IME and that she is to return on Monday, working a sedentary postion. my mother can't walk without assistance from a cane and myself. on top of that shes unable to drive. her doctor hasn't released her, the IME's recommendation is she could return back to work after she has fulfilled the treatment (spinal block injections & therapy) MIND YOU the IME saw her for a good 20 minutes, and has not seen her since then.

my question is who's right? I thought she had to have a medical release via the doctor before she can return back to work and he still has her on disability until next month. I can't physically drive my mother back and forth to work, get myself to work and my children to and from school. either, so I'm at the point of no return.

hope you can give me some insight.

I've had IME's send me back to work when I couldn't walk. My attorney always took care of it. Do you have one? If not I would interview a couple now. Without one if she doesn't return to work which is just ridiculous they will probably terminate her. What is her treating Dr. saying about this?

yes, she does have an attorney and this is my dilemma. the attorney's assistant said she should go back to work.

the doctor is outraged because my mother really can't care for herself.

she's 59 and weighs 87lbs. shes frail and needs round the clock care.

theres no way for her to be able to work or function. and I don't know what to do about it.

she doesnt have a choice she must go to work...get a friend to take her and walk her to her desk.....if she is in to much pain to finish the day have her call an ambulance to come pick her up at work and take her to the ER......sometimes you just have to suck it up and go to prove a point....and let em pay the ER and ambulance bill....they are heartless its bottom line for them....
