I went to the pharmacy the other day to refill my scripts, and they were denied by
my employers IC.

I am in NY; injured 10 weeks ago(L4/L5 extrusion). My employer has not filed any
paperwork with the WCB yet. The only reason there is a case at all is because I filed
the C3 form electronically.

I'm am not surprised by this latest tactic. I am sure they have their reasons, but I
can only speculate as to what they may be.

This kind of behavior is insulting coming from an employer that prides itself on it's
professionalism. It is the primary reason that I retained an attorney some time ago.

They did the same thing to me after about 10 months of the WC IC paying for my medications they had me go for a IME and had the doctor find reasons for me not needing medications for my injury. After the IME and sending me a note of the doctors findings they then discontinued paying for my medications. If you have a lawyer I would mention this to him/her and have them contact the WC IC to see what their reason is for discontinuing your meds. I contacted my adjuster because I had no lawyer. They still refused to pay for my medications.

First it was the medication they stopped paying and then when I went to pain management and the doctor mentioned a SCS ( spinal cord stimulator ) they had me go for a IME again with a doctor they paid to say I did not need one. After this doctors findings he wrote that I was a drug addict, and angry person, depressed etc. and this doctor wrote that my WC injury was not because of my job and discontinued to have me on WC. Now mind you I received an award for Permanent impairment through a court hearing and they now say this is NOT a work injury and said I no longer am entitled to WC now????? I have never been more insulted by name calling in my life!!!!!! It is all so untrue and if I had a lawyer I probably could fight it. I want out of WC because of all this causing me more depression by the name calling and BS they put you through. My doctors have done all the procedures and tests that they can do for me. The SCS I did not want anyways so I am not presuing it.

This is just a few of the tactics they will use to stop paying for things down the road. Another one of the WC IC nasty, heartless, degrading things that happens after a person is injured on the job. Good thing you have a lawyer cause you are going to need it. They love playing games and have no heart for anyone that suffers in pain daily.

Dark Star Make Sure Your Attorney is Aware, and They may have a Place to Call for You to get Your Meds. during Litigation. My Attorney found One for Me, and at that Time, 2 1/2 Years Later, and 12 Hearings I Won,and the Fee to the Pharmacy was, with Interest $32,000.00!! And I Received a Penalty Amount of $5000.00! Best of Luck, and I Hope You get This Straightened Out!!Wink

I really don't care if I can take this particular drug anymore(lyrica), I don't really care for it, and I'm not convinced that it is helping me. The concept that my employer can be non-compliant with everything and then just shut me off cold turkey is what bothers me.

The system really is set up to benefit the employer; for many people it is not even worth making a claim if they have their own insurance.

The employer has twenty five BUSINESS days to file their paperwork after the C3
has been filed. My employer was given an additional 10+ days with the threat of
a fine if they did not comply. And the fine was ?... $50. That must have really hurt!

On a positive note, I believe that they are helping make my case for me. We
shall see.

My Best to You, and I Hope You do Win! But if You can go on without Meds., or don't at least try and Fight for Them, it could Turn to Look Bad on You. I only Say this for Your Benefit, if Your Attorney doesn't want Your Case just Ask Him Straight Out to Sign Off of Your Case, and Release You from the Contingency Agreement, and Find another. I don't know Your Pain, and how Serious Your Injury is, but if You go without the Meds. and have to Appear before a Hearings Judge, the Very First thing They are going to Say is: "We Stopped His/Her Meds., and They didn't even Fight to get Them Back, How Injured can They Be??" I am Only trying to Inform You to be Pro-Active in Your Case, as I've had to Endure 15 Hearings, 2 Appeals, and I had to Testify at 12 of the Hearings, so I'm Well Very Well Aware of the Games They Play in the Hearings Room, it's Dog Eat Dog, and May the Best Evidence Win!! You misunderstood me. I am telling you that I don't care about taking Lyrica, but I have every intention of fighting this tooth and nail. As far as my scumbag employer, their IC and the WCB, I am furious about this; and I'm not just saying that, I really am. The outcome of this will impact my other meds as well as any future scripts and/or tests. I will fight this to the end, however long that may take.
Once I made the decision to "lawyer up" I committed myself to sticking it out to the possibly bitter end.

My attorney is working to schedule a hearing to force my scumbag employers to
at least reveal their intentions. It most likely will take awhile as I am not in dire
straights(in their opinion) due to the fact that I returned to work with restrictions.

I thank you all for your interest and concern as well as your advice.
