I got hurt in Oct of 08 I have not had one phone call letter or any comunication from my company!! Is this normal, Can they fire me without telling me , or what . Is it my duty to stay in touch with them? I am half leary on calling them because I do not want any thing I say mis quoted .

All employers have different rules. One that mine insisted on when an employee was out on WC was an out of work note from the Dr. every 6-8 which I did provide. I think I was replaced after one year, never told so but didn't actually resign until I was out for three years and settled my claim. An employer can terminate you/replace you as long as it's not in retaliation for filing a WC claim. Who have you had contact with ?? the IC ??? an adjuster??? a NCM??? do you have an attorney? The IC should be in touch with your employer. HAs your claim been excepted?


What state are you in? What is your injury? Has a DR. put you out of work?

God is never late.

What's best, what works, what will just do, for your employer, is up to you;

here is some food for thought;

After your next doctor appointment, ask for the reciept from that office, and your new out of work slip updated;

You then go to work, see your boss, or HR Dept. And hand them over a copy of the 2 slips you just got. You then should ask about (FMLA) family Medical Leave Act, which allows you 12 weeks off work to recover. But, after those 12 weeks are up, yes your employer can hire someone to then take your place. Your employer can keep you as a hired on employee, or re-hire once healed.

But, yes, please stay in contact with your employer, let them know how your doing, and what is going on medically.

You Mentioned You have Gone a Year without Contact with Your Employer, but Failed to Mentioned if You have an Active w/c Claim. Are You Currently Covered by One??Wink

Returning to work has a better result if you and your employer keep in contact. The longer you go without contact the less likely you will return to that employer.

On my posted question I did not say I live In ohio, and I do have a MCO who stay in contact with my employer with up dates from my doctors, but still I not sure If I call and say hello or what? I guess I got a bug up my but when I didn't even get a sorry your sick card or better yet, a Christmas card. As i said I got hurt in Oct so I really was upset with no Cards

Sam, I was Injured since 10/04, and when I Retained My Attorney, I wasn't allowed Contact with My Employer, everything goes Through My Attorney. As far as No Card, don't let that Bother You, when We become Hurt, and cause Our Employer's to File a w/c Claim, We become a Case Number and a File, and a Liability! Some Employers stay Very Active in Their Employees Recoveries, and Others Don't. I didn't Notice Anyone Mention Ohio, did I Miss Something Here? I Asked if You has a Current and Approved w/c Claim, which You didn't Answer, but I didn't See anything about Ohio! Any Way, don't let it Bother You, and Have a Great Day!!Wink
