Deposition on Mon.
I was wondering if anyone can tell me what to expect at my deposition?I appreciate all experiences or suggestions.I know to be honest and yes or no?Is it routine or should I be on guard?

RE: Deposition on Mon.
You being on guard should start from the second you leave the house....tell only the truth and do not pad the truth...if you cant bend over without pain...then say I cant bend over without pain not "I cant bend over" they will be there only to ask questions to try and see what happened and where you are at....before I was sworn in we were all in a waiting room and everyone was just chatting about what they did the night before yada yada yada....they had by sitting in that room found out I had 3 adopted children and had taken them to Branson the month before.once the deposition started they wanted to know if I was in so much pain how was I able to take 3 young children to an amusement park?I had my husband,22 year old daughter and rented a scooter....it wasnt an easy trip for me but I cant stop living either.....so stick to yes,no I dont recall...after each question look at your lawyer and wait to answer in case he wants to object to the question.....

;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....Smile

listen to jayne she is wright on point. your lawyer should prepare you before hand and never say you can't do something. your better off saying you have a hard time doing certain things you never know if there is video. take your time answering ?

RE: Deposition on Mon.
for the most part it's not as big a deal in workers comp as in civil cases where evidence of fault and/or negligence can be critical.

In comp it's mainly used as a extra fee generator for attys.
you'll need the names and dates of doctors and prior medical details; work history.
in comp liability is controlled by prior events/injuries so they'll want detail on those items.

You have every right to be nervous. Be yourself and be truthful. You will be fine.

Do not lie.
Answer only the question asked. Do not volunteer information. If you don't know, just say I don't know.
Do not lie.
