Injured at work, have questions on how to get treatment
I injured my L knee at work recently, going to an orthopedic dr tomm. My question is. What are my grounds for compensation if my dr keeps me out of work for a time? My knee has had previous surgery. But has been FINE for 2 yrs now until this injury. Can they claim it is an old injury?

thats all depends on if they say its comiing from the same area as previous area or if in new area... just telll the truth about everything and say what hurts and how .. just be tuthfully

just remember im sure this is their doctor not your own... telll truth to questions he asks but dont tell extras ..take someone with you ..its easy to forget that something hurt last night but isnt bugging you right now ... make a list of what problems you are having since everryplce will want to know how did it happen , what hurts , what tye of pain are you having ..
i m just starting after 1 yr of this finally keeping a printout that says what happened ,,what hurts ,,, becasue of all the parts that do hurt .. hint put your state in your profile since each state is different

Actually I went to their dr when it happened, he was only a pa, and told me to follow up with MY orthopedic dr. so i called human resources and they said iot was fine, and already gave my dr's their information. But my boss himself is being a jerk and Im concerned he is going to try to screw me here.

Welcome to forum.
I injured my left knee 11/05. Since I 've had meniscus surgery on both knees. The right knee was an overuse injury. I now need knee replacements on both knees. WC refuse to pay for the replacements, they say I had a preexisting condition. I have never injured my knees or been treated for an injury. I have an attorney and we are working through the court to get my needed surgerys. Good Luck! |

I'm sure every case is different, but in my case they covered me. I had a back surgery four years ago from which I was fully recovered. I moved wrong while working in Feb. and reinjured the exact disc I had surgery on four years ago. So far all of my dr visits, medications, mileage and surgery have been covered by wc. Good morning Kate and welcome. I suffered 5 injured body parts this time. This is my 5th WC injury with the same employer. I have always returned to work full duty and twice I worked with the injuries and never missed a day.
This is my 3rd back injury. 2 different disks the first 2 times and all 4 this time Have injured my knee once before so this is the 2nd injury. Ankle has been injured before , this time it was much worse. Shoulder is the first. Cervical ------ my job aggravated pre-existing stenosis. I was just awarded a favorable decision by the Judge on all 5 body parts. I feel IF the IC appeals it will be on a body part. Yes, they can claim it's an old injury. that's where your ortho and also possibly an attorney comes in. Wishing you the best. CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

I'm not sure what you mean by "grounds for compensation" e.g. wage replacement benefits/disability payments or workers comp benefits in general?
workers comp is a collection of differerent benefits involving temporary disability, medical, permanent disability, and/or vocational rehabilitation, and dependency in case of death. Each species of benefits has it's own qualifying events. your grounds for temporary disability benefits are the facts that a physician has taken you off work - either whole or in part - and your wages/income has been reduced due to an on the job injury. Your grounds for workers compensation are based on being injured either in a specific accident or thru repetative use in the performance of you assigned job duties. Documentation of these facts, of course, require the support of medical opinion. |

In easier words, Document everything happening to you, and make sure the w/c forms are filled out by your Employer and sent to w/c. Check your State Website for your rights as an injured worker, in most cases, if you aggrivate an old injury while at work, they can either open the old claim, or start a new claim as an aggravation to an older injury. Either way, I'm no attorney now, but you should be covered as it happened at work. Just stay on top of your paperwork, be truthful, and double check everything being done. it may not be easy, but you should be O.K.! Good Luck and keep us posted!!
