Can an employee get laid off while out on comp? State is Pa thanks |

I believe yes if for downsizing or just cutbacks... But if he fires you you may be entitled for some cash and he may get a hefty fine.... Im not a pro so I will leave the final answer to them........ |

I am also from PA> As long as you are not terminated for filing a WC claimand it is for cutbacks/downsizing as so many employers are doing then your employer has done nothing wrong. Being terminated has nothing to do with you being injured and having a WC claim. I tdoes not come to a hault if you are terminated.

Nothing in the state's workers compensation law requires an employer to create a job for an injured worker where none exists.

The answer is yes they can lay one injured worker off.

I'm from Pa. also, and the Others are Correct. If Your Injury should Heal, and You are able to Leave w/c and Your Case is Closed, You would then be Eligible for Unemployment.
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |
