My husband fell off a ladder and was diagnosed with a torn meniscus. The w/c doctor said surgery and he would be back to normal in no time. Had surgery, pt, and released to work light duty. Damaged again, sent back, another surgery and pt. Now it's worse than before. W/C sent him to another Dr. They did another MRI - now he mysteriously has a piece of metal in his knee. Anyway, I'm rambling. Has anyone else had this type of injury and what was their outcome. My husband just wants to get well and get back to work. They aren't going to hold his job much longer.

Was just curious what the metal was? Anyways has your husband used any of his FMLA time? If not he can and that will protect his job for 12 weeks.

Yes, he has used all his FMLA time. And we were curious also. The only person who seemed concerned other than us, believe it or not, was my husbands case worker. The w/c doctor even told her that my husband must have done it. She is sending him to another doctor on the 9th. We have been handling this all on our own because the lawyers only want to do anything if you are going to settle. The lawyer didn't even care about the metal. My husband has done everything he was supposed to with the belief of getting better and back to work, but it's really weighing on him now and I'll tell ya, we are both just so discouraged.

So I would guess he is not at MMI yet? I am not sure how he would himself put a piece of metal in his knee. That is crazy. So I would assume the metal is still there? Have you seen the MRI image with the metal in it? If not I would get copies of that. Sounds like maybe the doctor might have left something in there in which case you might have a malpractice case if the doc left something in there.
There is probably an attorney out there that will help you, you might just have to look a little deeper. What part of florida are you in?

Yes, we have all the before and after MRI's. We're about 80 miles north of Tampa. The original doctor gave him his MMI rating already. After that they sent him to another W/C doctor for a second opinion and that is where the steel showed up in their MRI which wasn't in the original. He is the doctor that told w/c that my husband must have done that to himself. So now he's off to another doctor. And the beat goes on.
