Truckster, Hang In There!! I think we talked about you going to a Neuro. before, have you done that!! And please be careful, too many ESI Injections in too short a period of time can be harmful. If you haven't seen a Neuro., have your attorney get moving on getting you to one. If you are receiving payments from w/c to be off, and you feel if they fire you they will stop, that's not the case. if they can't accommodate your restrictions at work, they have to pay until you are better, or they can find work for you within the Co. Try and get to an Neuro. soon, and your Attorney can fill you in on whether you are a candidate for Voc. Rehab. stay Strong, and Best of Luck!!Wink

Hi Truckster,
Get ck'd out by the neuro....this doesn't mean you'll have immediate surgery.
I also would be leary of my company suddenly not accepting my insurance payments....as all they have to do is say is that "you stopping paying" and poof... your insurance company boots you.

thanks everyone,no i have not been to neuro yet but we are working on it,i still don't understand why they won't let me pay health ins. either,the i/c ortho released me to work at medium duty,which i can not perform,hell i can't even cut my grass and he expects me to work on tractors....and limbo,as far as them(I/C) having to pay me,they have already sent me a letter that says they will reduce my benefits checks by 150.00 on 4/08 because i have been released back to work with restrictions and did not return...my fmla has run out and the way i understand it, pretty much everybody gets the shaft a few days after that happens but have not heard a word as of yet...i ran into a guy that also works at my facility and was also injured at work that had two shoulder surgeries and after his fmla ran out he was laid off 3 days later..... i will keep you informed as to what happens!!!!!!!

Truckster, your Attorney should be countering the drop in your Benefits with a Petition to Review Benefits, and if your Dr. pulled you from the Med. Duty work because of your injury, they cannot lower your TTD Rate. If you don't act on this soon, they will lower it because you did not respond with an argument on why they shouldn't. Is your Attorney w/c Certified? The reason I ask is I've never had to call and ask my Attorney what's next or find out elsewhere what to do. Example: My Dr. Prescribed a Mobility Scooter for me to get around better in. My Attorney sent a Letter to Defense Counsel requesting the Scooter. They Denied it. My Attorney Immediately filed a Petition to Review before he even sent the letter of Denial to me. These things should be automatic with your Attorney, and it seems like they aren't Moving too quickly. We spoke about a Neuro. Probably a month and a half ago, and you don't even have an Appt. yet. They need to move a little faster for you, before you end up Broke and with Permanent Nerve Damage!! Just my opinion Truckster, I'm concerned about you and the care you are receiving by both the Dr. and the Attorney. You've had way too many ESI's and you need to see a Neuro. A.S.A.P.!! Truckster...i think it depends on the employer with FMLA. Mine ran out in Oct and I haven't been terminated yet but that is my employers policy. I also don't understand why they won't let you pay your own benefits. My understanding has always been that if you are released to work and don't return you can be fired and your WC checks can be cut. I was always told that if an IC Dr. sends you to work and your Dr. keeps you out that your benefits should continue. Some employers are really difficult and will do anything to make your life miserable. Prayers are going up for you.

hi cap and limbo,the problem is that it's my employer that will not let me return to work,not the doctor...as i said before the doc has put me at medium duty with restrictions which i don't think i can do,but would be willing to try if allowed...in one of my old post i explained that employer allowed me to return for approx. 6 months under medium duty and then after a doctor visit because of problems with pain, they would not although the doctor did request a job decription from my employer which they said they did not have and told me to type one up and they would sign it,but when i presented it to my boss, he agreed with everything on it but refused to sign it although my foreman did...doctor changed nothing as far as restrictions so i don't understand whats going on....personally i think someone screwed up by letting me return to work the first time and their trying to figure out how to fix it with out me knowing how or why...like i said don't know why i havn't been fired or at least allowed to pay my own ins.premium and hr doesn't have a clue either,says she' waiting on corperate to make a discision on what to do with me...........how are you all doing today,well i hope...or as well as you can be!!!!!!!!
