Would it be wrong if......... *update*
The w/c insurance company owes me money for IIB. About 8 weeks almost 9 Plus they owe me mileage. I eight weeks ago was ok with money but that money is slowly going down to nothing. I really could use it and my attorney doesn't seem to want to PFB. Which I can understand why. But what would it take for him to call them and say...I realize you want to settle but you can't leave my client without income and income you owe her. So till you come up with something we need to start her benefits.
So what I want to know is would it be wrong if I called or emailed my attorney and told him to try and do something as I have told him many times I need money. Maybe tell him to call the work comp commisioner and let them know. I am no lawyer and I don't want to "tell" him how to do his job but, 8 weeks without paid benefits just because they want to settle is crazy. So how do I "poke" him to get going?

One other question. I was seeing 2 doctos and both doctos put me at MMI and now my orthopedic wants me to see a pain management doctor, do you then also have to reach MMI with that kind of doctor as well? The only reason I ask is because it was court ordered that the E/C pay me till I reach MMI. And also do pain magment doctors give impairment ratings?

You are at MMI right?

Have you had a FCE to show your abilties or work rating?

Disabled, Sedentary, No Restrictions or what?

By WC standards are you ready to go into the work force at some rating?

It seems YOUR Orthopedic is your personal doctor. He does not have to find you MMI. I am assuming your MMI Rating came from the WC System.

What are you expecting to happen after being found at MMI?

Just trying to help but need a little mor info.

The attorney works for you and you need to tell him what you want in regards to work comp. Your attorney will tell you if it is out of line.

Sounds like an assertive approach needs taken.

I don't have an answer about the MMI question.

To me sounds like your lawyer does not want the hassle but still want your money... I would presure your lawyer untill he does somthing, thats not saying you cant call (work comp commisioner). I have also called my WC adjuster when they were late paying mileage..

Yes at MMI from the psychiatrist and the orthopedic surgeon.
I have had a FCE done for sedentary. I can not lift/carry anything over 10 lbs Am waiting now to see a PM doctor which the orthopedic doctor gave me a referral for.

I have looked for sedentary work and even office jobs no one will accomidate my restrictions. I even have several emails from these job searches saying they can not accomidate my restrictions.

Well what I am hoping after MMI is that the insurance company would pay me my Impairment income benefits and my mileage that they owe me. And let me get on with my life.

Yes my MMI came from an authorized w/c doctor who just so happens to be the orthopedic doctor. He is not My doctor one that the carrier choose for me. My impairment rating is 15%

I'd recommend you talk to a few other attys.
trying to change an atty's habits is a bit of a waste.
if it's this now it'll be something else later.
better to look around before it gets worse.

Do you have an attorney? I was told that I could not call the w/c carrier. Also if I call work comp commisioner my attorney wont get "upset" about that?

I agree but changing Attorney's at this point in the game is near to impossible.
This new Attorney must be willing to "share" the compensation award with the original Attorney hence a "lower pay day".
This far in the game, I would be suprised if the OP can retain a 2nd Attorney.

Attorney's will throw you under the bus. They are looking for a payday and at the end of a claim they see nothing but dollar figures. It's sad but true.

FreeBird I am with you on that.
Right now I am in the middle of emailing my attorney and telling him in a very nice way.. get my darn benefits started. I am tired of "people" walking all over me and you know freebird you are 1000% right. Why would my attorney petition for benefits that he can not get some $$$$$$ out of.
The last time I actually talked to my attorney, all that came out of his mouth was, they e/c wants to settle. Ok great, but till then give me my money, but then again, if they put my IIB in the settlement my attorney will always get a % of that if the settlement is not broken down into amounts.
