I went to my os yesterday to get results of mri of my lower back. I have been on w/c since 12/06 3 failed knee operations. I have been approved by w/c for tkr, os would not schedule until after mri of lower back do to pain running down my leg. Was sent by w/c for ime and they said I had rsd POOO! W/c did not get the answes they wanted and now pay no attention to what the ime said. The mri show herniated dics L4,L5, and S1. I have pinched nerve roots in both L4 and L5. W/c did not pay for mri, they said it was "not a body part". With all the overcompensation, due to pain, being on and off chruches for almost 3 years, and in and out of braces, plus feel down stairs almost a year ago due to knee giving out what do they expect! How dare they not take responsibility for my back!

I do have a lawyer. He is so laided back! He tells me every thing will be ok, will all be taken care of in the end. In the mean time I am going broke, my husband Ins is paying some of the bills thank God but
we are covering the rest.

I hate w/c what a depressing mess.

Hi ,

You need to call your lawyer and have a sit down talk with him, to get the ball rolling. He may need to have other involved body parts "added" to your claim.
This is simply the way WC works....if your back was not mentioned on your orig claim...they won't just add it on their own....your lawyer must file paperwork to get more body parts added to the orig or a new claim. He may also have to schedule a court hearing.
SAVE ALL the bills you are paying that is WC's responsibility and give them to your lawyer for reimbursment after your back gets added to the claim.
Don't feel alone in this process....this is what WC pulls on everyone! It's a stall tatic to keep their money in their pockets as long as they can.

The first time this happens to people they just don't believe this could be happening to them but it does. You are not the first and thank God allot of folks don't have the same trouble we do with WC but it is the game some play. One thing I think helps is to think of your injury in a business view. You are costing them money and nobody likes to spend money they don't think they should have to. That is why we have lawyers but then it becomes a game of how can they get away with spending as little as possible. It's my quess that sending people to this IME's and doctor they are paying good money to say what the company wants must save them more money overall. It's a gamble for them, in some cases it pays off and in other they lose even more money. And trust me the last thing they worry about is how your life is. They don't care if you ar able to put food on the table. In fact I think that is what they want because if they get you down to where its hard to buy food just to eat then they think you will be more willing to give in and take what ever they are offering. Problem is what about some of us that just can't give in? We need the medical treatments just to try and live with as little pain as possible, we can't just give in and go find a job because who would hire us or keep us after they find out what we can't do. Yes there are some that can go out and find a job with the injury they have or can deal with the pain and stay at work.
I keep thinking sometime this will happen to somebody that can help get the laws changed so they help and injuried work more then hurt us even more but companies are smart and if somebody with that kind of pull could be faking their injury and they would pay them millions just so they wouldn't find out how bad the laws are written for the injuried workers. Hang in there and remember nothing happens fast in WC other then them stopping your money or treatments.

Thank you Lilly and Manley2 for your replys, it is comforting to kwon I am not alone. Also the advice and supports helps to keep me going, otherwise the depression would just take over.

Depression is an everyday problem and this forum is a great place to find help. There are many poeple here who have or are going thru allot of the same problems and we can depend on them to help us with many problems including dealing with depression. The off topic area is a good place to go and find something that can pick you up on a bad day. And God can help with everything if we let him.

How do you get a claim for an over compensated body part and how do they determine if it because you over compensated.
Like me I injured my right wrist and can not pick up more then 10lbs per my doctor even though it hurts to pick up 3 lbs. So everything for the last two years has depended on my left arm.
I wont say I do nothing with my right hand cause I do, Eat, try to write but alot of times when I do small activities the object flies out of my hand.
Any way I pick up my son all the time. He is 29 months old he weights 38lbs and is 38 1/2 " tall. I can not at all share the weight between both arms/hands/wrist. So I bend my knees and pick him up. But my arm is taking a beating. My muscle by my elbow hurts and I get back spasms. I have never had a problem with aching, never injured my back nor have I ever injured my arm on the left side. I am going to my doctors tomorrow do I mention this to him or do I mention this to my attorney.

Of course you mention any pain or discomfort you are having. Over compensation is not an easy thing to get covered by w/c, at least that is what I am finding out. You need to remember that you need to follow all the restrictions the Dr. has given you.

Manley2, Thank you, I pray that God will get me through this nightmare of w/c everyday. I do cry about it alot, my family have been great, I just do not want to be a whiny baby about the pain and frustations.

Without my wife and family I'm not sure where I would be. Still in bed and afraid to get out I'm thinking. It's hard sometimes for others to understand what we go thru. Everybody knows pain they just don't know chronic pain and understand what it is like to deal with pain everyday. My wife has back trouble so she is very understanding and that helps but it also hurts because we have to depend on others to do allot of stuff for us. With good friends and family around us we can get thru anything. God will be there for you that is one thing you can depend on

Yeah I follow the restrictions my doctor gives me that's why my left uninjured arm is very painful. When I bend my arm it doesn't hurt but when i pick up my son and then extend my arm when I let him down I get such a bad cramp, real bad cramp
