work comp payments
Went o work comp aug 2008 hired an attorney, the only thing attorney has done is have the deposition at his office, he told me it would probably be a year before heard any thing, its been over a year state disability stoped payments at the years end. not one of doctor bills have been paid or prescripitions or any compensation, i now am in serious danger of looseing my home, already living without pge,went to QME a month ago. laywer says basically sorry about my luck,maybe by december he can get something going!! Unfortunately i will have lost my house by that time and everything else i own!! Iam still under doc care still unable to work
CAN ANYONE GIVE ME ANY ADVICE TO HELP ME RUSH THIS THING A BIT FASTER PLEASE????? |

only thing I can suggest is call your congressman and senators....WC is hell on earth
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

I have been out of work and with no lost wage benefits since May of this year. I am contemplating contacting someone to help me file bankruptcy as I have spent all savings, sold and borrowed all that I can. Lawyer has very little to no communication. Humiliated during transportation to FCE which was a joke, and suppose to be receiving some lost wage benefits contingent upon appeal verdict by judge well that was offered 10 days ago still nothing. so I do not know how to rush anything in work comp it seems for the most part it does not protect the injured worker. I am Having to sell furniture I sold my bed and when couch sells I will be sleeping on the floor that should help my back injury don't you think? If your lawyer only deals with work comp then he has no dealings with other of your legal needs that is up to you, he is only concerned with your work comp case and winning his/her percentage of. He can only pursue as fast as the law allows and in the work comp law that means SLOW apparently. |

you didn't specify your state; each has different rules.
I'll guess california. your atty can request an expedited hearing at any time. you can switch attys at any time; there will be a single fee shared among them. |

[/quote You should have a disability lawyer and a work comp lawyer (not the same one) , and possibly a bankruptcy lawyer. Get specialty lawyers for each. Immediately call your mortgage holder and talk to them, the last thing they want is another mortgage default home on their hands and most states have now added home protection laws. I agree with the other folks on here. Your lawyer is NOT aggressively working hard to get your case settled at all. Are you using an "all-purpose" lawyer or a lawyer whose main focus is WC??
Also, my experience has been that multiple lawyer practices seem to run more efficiently than single lawyer ones (which are sometimes a joke...One Lawyer who has his wife working for him as a legal secretary, for example. When they go on vacation or just take a day off, do you think any work is being done on your case?? Nope!) |
