Knee Injury
I an from NY,Hurt my knee at work 5/08 had surgery on 7/08 lateral patella surgery release dislocated knee,after surgery i went to pt for 8 months until 4/09 I had to switch Dr's in feb 09 because my dr who originally did the surgery relocated(too far away) my new dr put me down to a 50% rating with light duty so my benefits were cut in 1/2 there was no way i could live on that even though i knew my knee was still very weak i had to try to go back to work so i said to my dr to release me to go back to work in 3 weeks he said ok,

I told my boss i would be back to work in 3 weeks he said ok,5 days before i was ready to come back he says to me that there is not enough work,he lays me off (oh i was very upset).

In the mean time i am off comp and receiving unemployment, July comes around my knee starts bothering me more and more now it is giving out while i walk i go back to my dr after a couple of appointments he requests supartz injections into my knee finally comp agrees to pay for the injections now it is mid August 09 once a week for 5 weeks i have my last injection next week 9/23 knee is still very sore and still giving out, no improvement.

while getting these injections i was sent to the comp dr for an ime, 2 weeks ago,i got his letter the other day he the comp dr says i can not return to the work i was doing before and gave me a disability rating of 40% on my right knee, I see my dr on 9/23 and need to get a medical report from him because the following week i have a comp hearing and the purpose of hearing is question of period and extent of disability question of rate of compensation and or weekly average wage question of lost time

should i let my dr know what disability rating that the comp dr gave to me? 40% on right knee, just thinking if i dont inform my dr what if he comes up with a much lower rating than comp dr?

my dr now also says that i can not go back to the type of work i was doing.

I was getting about $445 weekly from comp when I was on comp. i was out on comp for about 10 months.

not really sure what to expect at the hearing i do have a lawyer what questions should i ask my lawyer or my Dr before the hearing?

what if they offer a settlement what type of settlement $$ am I looking at I have no idea just wondering thanks

one more thing My DR also said that within 5 years i will probably need total knee replacement

I went to my Dr. today he gave me a 50% disability rating he says i can not lift more than 20 lbs i can not do the previous work that i did,today was my last supartz injection which has not helped me to date at all have been getting them once a week for 5 weeks, my knee is still giving out i am walking with a cane and i also use a brace on my knee,he just tells me to go get a sit down job and will not put me back on comp he tells me to get vesid? who will hire me i am walking with a limp i am walking with a cane i can not stand for more than an hour at a a time my knee swells up lots of pain he says i will need a knee replacement within 5 years but will not do it now im too young,i am seriously thinking about going to another Dr for another opinion, my previous Dr was very nice but he moved his practice too far away now im stuck with him your thoughts?

lost in NY get this on the way out of the Dr office today i was talking to the PA the Drs assisatnt and she says to me even people in wheel chairs get jobs wow i was PI$$ed i than just walked out

Welcome to the forum!

I also had a work related knee injury. Mine was bilateral and to date I've had several surgeries with the last surgery being a total knee replacement.

I was sent to a total of 12 doctors by the insurance company on the knees.
Every doctor I saw said the same thing, that I needed a TRK.

You will know when it is time for the replacement.

Some doctors will not do the replacement on someone younger then 50, but when your knee is bone on bone and you can no longer place weight on that knee with the pain being a 10, you will know the time is right for the replacement.

I know WC just about the worst thing that can happen to anyone, esp. the way the system works but I am not collecting anything from comp now and want to go back to my original Dr. at least he cared for me and tried to help me as much as possible with my knee problem, My Dr. , now maybe just doesnt really care since he did not do the surgery and just keeps dragging me along and seeing me since he got no $$ from any surgery I had, It just seems to me he has no care in the world for me.

I tell him about my problems but he never has an answer. like why is my knee giving out I still have pain I still have swelling my knee is still very weak? its been 16 months since my surgery with my previous Dr.

I am just lost why some Dr's care and some dont esp. when the Dr you are seeing now did not do the surgery..

The Supartz injections have been no help whatsoever,actually it has gotten worse and I tell him this and he still says nothing,I am just at a loss.......

Your not at a lost. You need to get up, get out the phone book, find a another OS doctor, and then get another medical opinion. It is just that easy.

Sorry to say though, you will need to pay for that. But, you still have options left, that you haven't used.

Supartz is a solution of highly purified sodium hyaluronate. Supartz is one of the hyaluronates used in viscosupplementation.

Supartz is injected directly into the knee joint to restore the cushioning and lubricating properties of normal joint fluid.

Supartz injections are approved for the treatment of osteoarthritis of the knee in those who have failed to respond to simple painkillers, exercise or physical therapy. Use for other joints is being investigated

Results are only to be shown up to 3 months after last injection. Meaning you have to wait 3 months or up to 6 months to know if the injections had worked at all.
