I got a letter from work that reads....

Quote:Dear Dipweed,
This letter is to inform you that FMLA Leave time will run concurrently with your Worker's Compensation Leave.

Our goal is to get you back to work as son as the physician has released you and certifies that you are able to perform the essential functions of your job as you follow the doctor's recommendations. We would like to assist you in any way we can as we move towards that goal.
Please feel free to call me at my number if you have any questions or your status changes.

What yall think? Is this basically them telling me that I have until my FMLA time runs out to return to work, or they will fill my job? The company I work at is generally nice, but they are money hungry too (like most companies are).
I KNOW that once the FMLA runs out, I will lose my health insurance from them. Any advice from anyone who has been at this point in the "game"?

I think that it is ledtting you know that your job is only protected until your FMLA runs out. How far into your FMLA are you?

yes, if you can't return before the end of FMLA then you'll be replaced. You might contact them about light work opportunities.

Currently I'm only into it by 2 weeks. Have a MRI arthrogram on the 27th to determine the extent of sholder injury. Ortho believes it is a Labral tear, but the insurance comapny isn't convinced. Ortho was ready to do a Bankart procedure wih decompression but insurance company wants to fight it.

In my case ,I was on FMLA ( 12 weeks ) and LOA, I was released to light duty at 12 weeks and 3 days, No lighte duty available, and was terminated, So yes they can terminate you at the end of your FMLA and they can run together.

Lets, not forget, that when FMLA runs out, you can always ask the employer in writing if you may have an extension. it's only a 50 / 50 chance too. But worth the try. I do think towards the end of the 12 weeks, you can have your treating Doctor also fill out a form for you.

Depweed, some organizations have a policy on un paid leave for X amount of weeks beyond the FMLA. Do you have an employee hand book, if not call your HR person and ask that one be mailed to you or pick one up. This will give you a lot of infomration about your rights.
