RE: Back to work
Here is the catch though... I am technically still employed by the ambulance company... the one I was employed with when I was injured... so wouldn't wc still have to pay for hours missed from that job since I would no longer be with the job that I took after the ambulance. I know this is very confusing.
I was working for an ambulance company and got injured while working for them. I was being paid by workers comp. I had to get another job because workers comp checks were not coming in in a timely manner. I was cleared to do a desk job but not EMS. I am still employed by the ambulance company. Because the doctor wont clear me to go back to EMS wont they have to pay me for hours missed at the ambulance company?? |

RE: Back to work
If you are making less money than you were I believe WC should pay the difference between the 66 2/3% and what you actually are making now.

RE: Back to work
No, from everything I have read, all they pay if you have a different job is the difference between what you made there and what you now make.

But if I quit the job I have now i will be making nothing. Therefore the difference would be 66 2/3% of what I was making at the ambo company... |

RE: Back to work
Yes that is correct. However I do not know how this works in your state. In mine if you go back to work on lithgt duty with the correct paperwork and cannot do the job wc is automatically restarted. If you can do the job and accept it after 15 day grace period then if you quit they may not have to pay wages.

RE: Back to work
Marine, Please Contact Your Attorney on this Matter, Our Opinions are just that, and the one that is going to have to do the Work on this is Your Attorney, and from what You are Posting the Job as a Security Officer is Over and Above Your Restrictions, if You were Released to Desk, and You are doing More, and that alone can Cost You Your Case! Your Attorney would be the Best to Guide You, the Ins. Co. could now Say that You Further Injured Your Thumb by Performing Security Work over and above Your Restrictions, and if so, You can and Will Lose Your Case! If Your w/c Checks were Sporadic, causing You to get the Job You have, Your Attorney could have Filed a Petition for Non-Payment of Monetary Benefits, and Possibly even gotten Penalty Monies for You! It seems You May have Jumped into this Security Position too Quickly, and Your Attorney is the one to try and get You out of this! Best of Luck!!

The doctor did release me for asset protection/security. So w/c cant do or say anything about me going to work for asset protection. My attorney is an aruba right now. |

RE: Back to work
I agree with Limbo....as this is sounding a bit complicated and I feel your attorney could better answer your questions. I know your attorney is in Aurba right now but be patient and when they return you need to get together with your attorney, PRONTO! We would love to be able to give you all the correct answers but I know I for one do not know the laws in your state regarding comp and would not want to advice you in the wrong way. None of us on this forum would want to do that because we sure would feel really bad if we gave you incorrect info. I certainly wish you the best and I pray this all works out for you. Please keep us posted as to the outcome of this situation. Take care and God Bless.
