Injured at work; now I'm not able to walk very well
I work for a major package delivery company; one of the biggest in the world; and I fell out of the back of a semi truck when another employee pulled the truck off the dock w/o looking to see if we where out of the truck yet (it's company policy to look before you move the truck).
I fell hard on the ground and my legs have been hurting ever since; it's been about 6 months. Its getting so bad now that I can bearly walk around. I'm 54 and can retire this Nov. If I attempt to sue, the company will fire me; thats company policy. Can workers comp do anything for me? Thank you! |

It's illegal to fire an employee in retaliation for filing a claim. If it was company policy, your labor commissioner would not let them operate in your state. You can file a complaint if that happens. In fact many states mandate the company provide lite work for those with injuries.
Workers comp can pay for your medical and some wage replacement benefits. workers comp is "no fault" -- who's fault it was is not an issue. If it's on-the-job then they pay. |

Welcome to our family oriented forum. This is the GREATEST group of people you will ever find. Always willing to help and offer their support. Sorry about your injury and the WC world is not a nice one. I pray that you will get the medical attention you need and you need to file that claim and not be afraid of your employer. Sorry you've been injured. I know that it isn't any fun at all.
Did you report your injury at work? Have you seen any dr.s at all? I agree that your company can not fire you for filing a workers comp claim. Check your state rules for how long you have until you have to report an injury. You should be able to find information on this website. Good luck! |

Smiley, If I am reading your post right Your company can fire you if you sue them, But sueing and WC are two different things, Did you fill out an incident or injury report when you were hurt, Have you seen any Drs for your injury? had x rays, ct etc. It would also help if we knew which state you are in. Can you give us a little more information?.

I agree with everyone else. You are not sueing the company you are filing a work related injury. I hope you filled out a report when you got hurt and you should really be getting medical treatment asap. And just a little insight, when I first started having problems with my legs I went to the doctor only to find out it was MY BACK!. But there is a time limit on filing a claim so you need to get on that right away. |

I'm in Colton CA (SOCAL). I did fill out a work injury report and it clearly states that the injury was not my fault. I have been to the doc many times and had x rays but I told the docs I thought I was ok to go back to work b/c I didn't want to loss any hours.
I can retire in Nov this year. I'm wondering if I should retire then work on sueing the company if I have a case. It was clearly not my fault, I was unloading a semi truck and another employee jumped in the driver's seat and moved the truck out w/o checking to see if anyone was in there. My legs have gotten worst and worst every month. I can bearly walk around the grocies store anymore; I only last about 15 mins then I have to go wait out in the car or on a bench. Thanks guys. |

you CANNOT SUE THE COMPANY WC is no fault the company is protected....big money in the right pockets protects them
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

My friend hurt is back dropping off Budweiser shippments and sued them. 3 years later he's settling for almost 2 million. I don't care if I get them much or not but I'm looking for them to take care of my injuries and family if I can not work.
Am I asking too much? |
