IME questions about IC Dr shopping
So, I have seen several WC Doctors, all of which have been selected by my WC Insurance Co.
The last primary Doctor who was treating me was suddenly "dismissed" when he wrote in one of the reports that my injuries were directly related to the fall I had at work. So, then onto the second primary Doctor. He also said my injuries were the result of my fall at work. So, now all the sudden the IC wants to send me for an IME with another of their Doctors. How may times can they do this? Good Grief, I am tired of them sending me all over because they don't like the answers they are given. Anyone else had this experience, and is there anything I can do about it? I am in NM. Thanks

http://www.workerscomp.state.nm.us/ if they are looking to reject your claim and deny benefits it's time to get legal help. |

However, I was sent to 5 (that's FIVE) doctors before WC got the message. One thing you should know....If W/C continues to use this strategy, and in so doing, causes your treatment to be unnecessarily delayed and that delay causes you more pain or injury, you may be entitled to seek damages (Make sure to check with your attorney as I am not familiar with the laws of NM). I any event, the universal W/C strategy is DELAY, DELAY AND MORE DELAY. It is an unfortunate truth of W/C. That said, you DO NOT have to stand for it. Keep in close contact with your attorney if you have. And, if you don't have one GET ONE!!! Good luck and take care. |

there are no "damages" under workers comp law.
it is extremely difficult to find a lawyer and prosecute a carrier in civil court for bad faith. |

Hi Boo! I'm not Sure of Your State, but in Pa. they can IME You Once every 6 Months, and they have to Act on the Report within I Believe 30-60 Days after the Dr.'s Final Report. I Believe what jennco was Meaning by Damages may be a Penalty Petition for Unnecessary Medical Delay, which May or May not be allowed in Your State. I have Won Penalties Twice for Lack of the Ins. Co. paying My Meds., and also for not Paying Me the Correct TTD Amount. Best of Luck, You May want to Seek Counsel, they seem to be Coming at You Hard, and You don't want to wait until the Case is too Far Gone for Help!!

BooBoosNeck, I too would object, but, my God, I sure hope your being treated by a Doctor? And if so, what is taking place for treatment?
