Hi Everyone,
I was hurt and reside in NY .
My atty asked for section 32 agreement (settlement)and the carrier responded in the begining of May they were not intrested until they had a pre trial with special funds. Who is Special Funds ? Whats a pre trial and Does that process take a long time ? I suppose they are trying to get money from someone else> Can someone shed some light on how long that takes and would they pay my settlement.
At least they are willing to settle it looks. sent me papers some time ago for med auth in march as well. I been on comp since 2006 and I want out of this mess.

sorry I do not know NY rules but wanted to welcome you to the forum.....someone will be along soon to help you out

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

Sounds like you might be talking about the Special Disability Fund. It is special fund, technically known in New York as the Special Disability Fund, which assumes, in certain cases, part of the permanent disability liability resulting from injuries to previously handicapped workers. The fund, which is funded by assessments against carriers and self-insureds, was created to assure handicapped workers receive full workers' compensation benefits, while encouraging employers to hire physically handicapped persons by protecting them against disproportionate liability in the event of subsequent employment injury.

The insurance carrier/employer has to file with them to get reimbursement. Sounds to me like they need to come to an agreement with them before they decide if and how much they want to settle with you.

Sorry, as both injured worker and adjuster in Florida, I didn't have to deal with that. I know there are some others here from NY that may have more info for you. Just keep checking back.
