Question How can I work light duty, when I'm restricted from driving
II'm a newly injured (6/9/09) Federal WC situation in PA. The ER visit following my fall at work diagnosed me with a sprained knee. Paperwork through my employer was not done immediately following the accident, which prevented the recommended ortho. office from seeing me for a followup until they knew my claim #. 2 days later, I went to my family Dr. because my leg really hurt and I wanted a note to cover myself since I planned on staying out a few days and the ER doc only excused me for 1 day. (She told me that's all she was allowed to do. ) My family doctor wrote out a letter that said I was disabled from 6/9 thru 6/20 and recommended a Dr. at the ortho office, which I turned into my employer. My spvr. still had not filled out the CA 1 or given me any kind of information. He told me he did what was required.The dept. mgr. stepped in, filled out the paperwork and provided me with the CA 1 R&R's, and a CA-17. I got an appt. with the ortho, but instead of the dr. I saw a phys. asst. She reported to my employer that I had a miniscus tear and altho I was not allowed to drive, and need crutches to get around, I was able to return to work on 6/15 because I am able to answer phones. Now my employer is telling me that it is my responsibility to find transportation to work (I work night shift) because they do have a job for me. Can they do that?

unless you can show there is no alternate travel arrangements available for your employment, getting to work everyday has always been the employee's responsibility.

I don't see why a meniscus tear would stop you from driving. So, it is up to you to get to work. Get a ride, take a Bus, take a Cab if you don't want to drive. Sorry, but that is the way it is.

The Drs. restrictions must be reasonable and certainly people walk around (and drive) for years with similar injuries. Perhaps driving referred to OTR work, commercial driving etc ?
