let me ask you this i was injured 9-18-08 the insurance paid me for one mnth then they denied claim i finally setled with them at a brc for very much less than they owed on my atty advice we settled for 26 weeks instead of 40 but the atty been billing like he was going to get the full 40 my contract states 25% of settlement so can he get more than the 25% of the 17800.00 - 2800.00 i received before i hired him

all the fees have to be approved by the comp court. you can file an objection with them if you want to challenge the fees.

I am in the same situation as you are, also being in TX. I agreed to the 25% of all benefits (other than travel pay) when I hired my attorney. I was recently given an IR of 8%, this giving me 24 weeks of IIBS. My attorney is to get 25% of each check, or just a few cents over $60.00 per check. That in no way will add up to the amount she has filed in fees .. as of April 17th, there were over $5000 in fees. She still has from April 17th to todays date worth of fees to still send in. By receiving only 25%, that only comes to about $1440 in fees she will be able to collect. I am afraid to even contact her over this, as she charges me $75.00 for a single 5 minute call, and $150 to answer an email. I need to know if she can come after me .. such as in sueing me, for the remainder of her fees. I also need to find out where my travel pay stands. I had to drive 119 miles one way to Dallas to see the one Dr that would see me while I was fighting my denied claim. I have close to 2 grand coming, and I don't want to loose any of that in fighting for it. If you and your attorney agreed via contract to 25%, which is the mandatory amount in TX, then he will not get more than 25% of any settlement or IIB's checks that you receive.
