Question about workers comp and work
Hello I was injured on the job. I hurt my back. I live in Texas.

I filed a accident report, and I started seeing a doctor that I choose. No one told me in the beginning it had to be a workers comp dr or a dr that accepts workers comp

I then went back to work to fill out the paper work 2 weeks later for workers comp.

My question is now workers comp did pay for a few visits, but now they are saying it was not reported within the right amont of time. I did find the info on the internet that says the injury has to be reported within 30 days, which mine was. Workers comp then denied me and said that they are not going to pay for anything eles.

What do I do next ?

Thanks

1171 is correct. They should be able to point you in the right direction to handle the situation.

8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom.

RE: Question about workers comp and work
Lolli,

It might be time to look at hiring a good attorney as well, as fighting a denied claim can get quite involved and tedious. I fought for over a year here in TX on a denied claim. I was found to be MMI (maximum medical improvement) the 16th of April, without any kind of treatment other than diagnostic testing. I was given an 8% disability rating (24 weeks of IIBS) and had my claim finally accepted. I can now try to get some kind of treatment, as WC insurance is for life. I doubt however that anything will help after 16 months of being injured.

Do not let anyone stop you from pursuing your claim. If you were injured on the job, and the IC began paying your bills and then stopped, they must send you a letter explaining exactly why. If you haven't received this letter, contact the adjustor that is handling your claim for the insurance company and demand your denial letter. Also, in the state of Texas, you must file with the Texas Department of Insurance, Division of Workers' Compensation within a year of your injury. It can be done online at the following website:
