Light Duty Work
So I am not new to W/C... I have been off of work since a surgery in October. They have had no light duty work for me to perform until now. I am having another surgery next week. My question is when they find light duty for me to do, which in this case is at another place where I will be "volunteering my services" but getting paid by my employer. Is it allowed to pay me $6.oo less than what my hourly wage was before I was injured?

Most states pay a portion of the difference if you are making less than before you were injured. What state are you in?

In Nebraska:
Temporary Partial Benefits are equal to 66 2/3% of the difference between the average weekly wage before the injury and the average weekly wage the employee is able to earn thereafter, not to exceed the maximum. Calculated as (AWW - post-injury earnings) x .6667 = Weekly benefit. Temporary partial benefits are paid during the period of partial disability, but not beyond 300 weeks. |

I worked for the Sal army many times the local chicken plant sent their light duty to me...Funny when i got hurt they couldnt find light duty for me
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....
