unfortunately they don't keep score that way. there is no history; every issue starts out 0-0.
they don't care whether you go away or stay. comp is a system and an institution; not a person. like the ant colony in your garden: it doesn't care whether you are having a good day or a bad day. the attys are liking the fees so there is little incentive for them to do anything other then keep the litigation going. you can be cooperative or not -- it doesn't affect or change their behavior. that's why the frustration level can be so high; they are not a person and impervious to such strategies. ![]() Even Lieutenant Data couldn't "out-reason" with the Borg. the system is hard-wired to follow a certain path. the alternatives have been worse. if decisions were made on who they liked and who they didn't it would be even more intollerable and unfair. hopefully national health care reform will reduce the consequences to a flawed program.

1171 You have hit the nail on the head......I could actually tell you how to build a house from the foundation up. I know every wild flower in PA I can deliver a baby or sit with an elderly person who is not going to make it through the night. I am a friend, a lover, a Mom, sister a person with more comapassion than law should allow. I have been through more he// than most people would even dream of....I have gone to work after having IV antibiotics infused 1/2 hour prior to my shift. I was strong,, Now I am a number, a case, in their minds someone who is trying to beat the system.....Hopefully things will change, but there are always those few who will throw a monkey wrench into it.

geez 1171 for someone so smart how in the hell can you be so dumb? national health care will be WC nationwide......I have been part of national health care while spending 7 years in germany...talking about a bloody nightmare...waiting months for a Doc visit and going to the drug store for any help except childbirth and Emergency...all national health care is a nation wide welfare system those who can will still buy insurance the rest will wait or see substanderd Docs just like WC...Good Docs will be part of private insurance those Docs who cant get insurance because they are quacks will be part of national health care and just like WC you cant sue the bas turds......another fairy tale hand fed to the masses by a batch of goverment clones.........course it is another way for the goverment to control the masses.....then newborns can have a micro chip slipped under the skin at birth......better to control dont cha know
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

You just continue to stay strong and you will succeed in the things that are due to you and your family. Why? Because you got up and went to work that God aweful morning the day you were injured. Then you injured yourself trying to protect someone else from being injured. People react to situations but I would say your reaction was one that is the norm for a person with such character as you are made of. I would not expect anything else from a person like yourself. Thanks Everyone, and 1171, I Understand Your Reasoning to a Point. I don't know of All States, but in Pa., when a W/C Judge Rules on which Side is More Credible, it is Virtually Impossible to get a Worker Comp. Appeals Board, or even the Commonwealth Court to Reverse that Decision. So by the Judge Ruling that I and My Dr. are the Credible Parties, it makes it Much Easier to get Rulings in My Favor, if they were Found More Credible, My Battle would be twice as Hard and More Uphill than it is Now!! So when I give that Count, it's not to Brag, it's to Show how Lop Sided this System is, I can Win so Many Times, and they can Still Battle on, and Put Me through He**! I know I'm a Case File, and a Claim Number and Liability to them and always Will Be, Unless We Settle, but I will Sure as He** be a Case File, a Claim Number, and a Liability They Will Remember if I have My Way!! My Attorney told Me this Case will Change Pa. Rules and Regs. at Least 3 Different Ways by the Time We are Done, and I know this Puts Feathers in His Cap, because W/C Judges are Appointed Here, not Elected, and they were Usually W/C Attorneys before Appointment. There are Only 2 W/C Judges in the County I Live in, and they are Both wanting the Ins. Co. to Settle, and One of them this Week even Made it Clear in Front of the Defense Counsel that I could Very Well be that Rare 51% IRE Rated Injured Worker, and My Attorney felt that was a little Nudge by the Judge to the Defense to Re-Consider Settlement Figures! Thanks For Replying to My Thread, I know You Usually Don't on the Off Topic Section, and Trust Me, My Eyes are Wide Open, and I have a Pretty Good Idea of how they Think! Thanks Everyone for the Strength to Battle On, and For Allowing Me to Rant and get these Things Out of My Head to People that Understand!!

There ya go, let's get some of the rules re-written for our state in the law books with our cases. You will not stop fighting and neither will I. This is how my case made it into the law books for my state. This will now help others who have a similiar situation and our cases will be used as a reference. We can't stop the battle because they will then win for sure and we will not help anyone in such a situation. We can fight on and re-write as many laws as we possibly can if it will help someone else. Your case if going to make law history for your state as well as mine did.. It is through people like us who refuse to give up on our battles. This just paves the path for others although we had to experience our trials and tribulations, that is alright from where I am sitting and I feel you will feel the same way. Move forward and stay focused and on track. I always told my lawyer when we faced appeal after appeal that I put it in the hands of a much higher power and he has never failed me yet. Hang tough my friend, we will see the end one day and will have helped others throughout our journey. Take care and love ya!
