Question On the job accident in MS!!! Looking for input???
On 06/02/2008 I was at a particular job site. We were scheduled to place dirt due to drainage reasons. While visiting this job site to make sure things were going well I approached the dozer operator to inquire as to how progress was going. While talking with dozer operator a truck load of dirt was pulling in. Apparently the operator was excited because before I was able to dismount the dozerthe operator had fired it up and started a forward motion which scared the crap out of me. I jumped from the dozer and landed on the right side of my body(as if laying in the bed) before I was able to recover the dozer started backing up and I realized that I could not move. I looked down at my feet and noticed the dozer was on them and I was unable to move. I figured the dozer would roll of of them and then I could get away. Before I knew what was happening the operator adjusted in reverse and was traveling up the left side of my body. I can recall every little thing that happened as if it happened a few minutes ago.
To make a long story short I received a crushed pelvis, severe nerve damage(inner thigh of left leg)and am suffering from incontinence and sexual dysfunction.
I have done everthing that was asked of me by doctors and physical therapists. I have had an FCE and have received a 15% whole body impaiment. I have reached MMI from the main doctor(orthopedic surgeon)
he concurs with the FCE and states that I have 15% whole body impairment not counting the incontinence and sexual dysfunction. I am wondering if anybody can shed some light on this 15% whole body impairment and how will it relate to a disability rating.

RE: On the job accident in MS!!! Looking for input???
the higher the impairment rating the higher the disability rating given by the state. those with larger disability rating will get permanent disability payments for a longer time.
a worker with a 25% rating will be paid disability longer the someone with a 10% rating.
you can find out more here
http://www.mwcc.state.ms.us/_main.asp
ratings have nothing to do with how the accident happened or who's "fault" it was.

Holy Crap Bulldozer! What a horrifying experience!!

My question is...do you have a lawyer? If not...get one! 15% seems like a very low rating to me with all your lasting injuries. Get a certified WC lawyer and A GOOD ONE at that!

Also, have you been checked out for PTSD....as you seem to be re-living the incident, which can really raise havoc with one's mind!

I wish you much luck! LillySmile

Injured worker, & tired of it all! I'm too old for games!!

A careless word may kindle strife, a cruel word may wreck a life, a timely word may level stress, and a loving word may heal and bless!
