Well seems the employer has seen a new path. He called nephew today and said his home owner inc is going to be calling him. I think he realized what the outcome could have been. I told my nephew not to sign anything until he decides on a lawyer, and let the lawyer handle that.
But on his health, he is still in a lot of pain but has been getting better they added another pain med starts with a P. But Im just glad he has got some relief as many of us all know thats more important than anything.

You are correct fencer, It was a relief to hear he gave in but now lets pray the ins company sees it that way. Maybe we need to do some spirit chanting or somthing to put the peasure on WC adjusters and DR's. Let me adjust what I just said, some WC adjusters and DR's.

I hope this works for him.

Very strange, if he was getting a pay check, each week, he has the proof to show employment. Being an employee that would go from site to site, he should be well within his bounds of a workmens' compensation claim. But, and I do say but, he would be well better off with the home owners insurance, as pain and suffering is allowed.

I do have a thought on that also, I have a gut feeling he dont have WC ins. Weather it be because he just started back up from the winter off and have not paid or just dont have it. I dont know how thjat works for seasonal employers but I did try to find his wc carier and cant find it. I do find many other construction company's listed but not his.

Many times construction companies think that if they say that the employee is an independent contractor that they don't have to have WC coverage, but in most cases, the laws are very specific about what constitutes an "independent contractor" and in most cases the employee doesn't qualify. It's a money saving tactic.
