HI all,

Thanks again for all your help.

I have one more question, if anyone knows.

My restrictions including 'sitting down' only. My own employer does not offer this type of work.

I've since been contacted for an interview with another employer for a completely 'sitting down' job. I'm thinking, I can't wait for those to work stuff out to get paid, and I'm also thinking, if I can sit down and work, I can support my child properly and not lose everything I worked so hard to keep everyday. (apt, car, etc)

Can I interview and accept another position, so long as it conforms to the medically necessary recommendations of the WC doc I saw?

Things are getting hotter at my job with all this.....surely I'll have some interesting things to report tomorrow.

work comp does not prohibit job change or employer change to accomplish accommodation to work restrictions.
if the restrictions are temporary it may make you ineligible for some temorary partial benefits.

Gate, In my opinion, if you can get a job within your restrictions I would jump on it. I have been out of work for a year now, my lawyer keeps saying "if you take a job, your saying that you CAN work, and won't get the FULL benefit". At this point I am willing to drop this whole WC crap if I could find A job within my restrictions. I saw an ad yesterday for what I call my "dream job". I have applied, and found that I know someone in the company, so am almost gauranteed an interview. If this job is offered to me, it will pay close to what I was making and I will take it in a heartbeat. Good luck with whatever you decide to do.

Thanks for your imput, and GOOD LUCK with that interview! Get that dream job; many times, it only comes once for any of us.

The doctor didn't say I couldn't work; he said I couldn't walk around, and had to have a job sitting. So, for me, I'll hope to get what I want: Simply saying, I want medical care, which both the employer is now denying me.

I started a new job before my case was settled. If anything it had a positive effect on my settlement. The arbitrator was impressed that I was able to find a position within my restrictions and was earning the same as I was when I was injured. He also awarded me a higher % of loss than I expected, but I had a very talented lawyers o that may explain why that happened.

Unless you are looking at a total disability I would think getting a new job wouldn't do anything negative to your case.

I also got a job offer that was almost 8.00 more an hour from where my husband worked when I was put at MMI while I was on light duty. I jumped at the chance because it was within my restrictions. I was never going to be able to do my career again that I was doing for 15 yrs. So I say if it is within your restrictions I would go for it because if you do not the only thing you have facing you down the road is maybe not being accepted back at your old job, or put on light duty there, or having to go to voc rehab to train for a job that you would be able to do.

So yes. I say go for it. You would be a fool not to. And you would still get your medical taken care of cause that should not effect anything because you left your place of employment. I am still being taken care of now for 2 yrs after leaving mine. Unfortunatly I was just laid off March 2nd. which really has been a blessing for me to heal and take care of myself as long as my husband has a job and I am collecting unemployment.
