Hello everyone- I was hurt Oct 2008, Right wrist, had surgery( metal plate and screws). I've been out on OJI since. Wrist still very painful and little swollen, on pain meds. All was well tilll Dec. I have been receiving my paycheck ( direct deposit ) from employer, then wc checks started to come in, I had called my wc case advisor and was informed that she had made aggrements w/employer that is why I am getting my pay. I didn't question her again about this. Last week employer found out that payroll has been paying me and wc has been paying me thats when the floor fell from under me. What do I do now? I know now that I shouldn't have listen/ trust the insurance co and kept on questioning this double payment. Now I don't know what is going to happen. I am now under investagation with my employer and wc has stopped my checks. Any help and advise? Thanks

you didnt know....make arrangements to pay it back......being up front and honest will help but it is gonna hurt

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

a repayment plan might endup being a good incentive for them to take you back despite your injury. (many employers tend to cut loose those out on leave.)

Every cent you received for disability payments directly from WC needs to be paid back to your employer, if indeed they paid you your full wages. Honestly is the best policy. Write your employer a letter with a payment plan included. Take responsibility and apologize for the error. You knew you were being overpaid. Good luck, and I hope you are able to keep your job.
