Wink Carpal and cubital tunnel syndromes
Hi, need some advice for IL. Type on computer all day for work. Began having pain, numbness, tingling in hands, wrist, arm, and elbows. Hands also started to swell. My primary doc dx bilateral carpal tunnel and bilateral epicondylitis in 01/08 by my primary doc ordered IME=neg, off work x 2 weeks, pain meds, referral to hand specialist. WC approved treatment of bilateral carpal tunnel only but said if I wanted treatment for my elbows I would need an IME first. No relief from wrist/elbow splints, time off, pain meds, OT, and steriods inj so I had R hand CTR in 02/08 and CTR on L hand 04/08. Returned to work but over time pain in elbows became worse and started to have pain, numbness, tingling, to both hands and wrist again. Surgeon ordered 2nd EMG 10/08= neg and work restrictions. The job did not accommodate restrictions, told me to stay home and WC payments restarted. FCE per surgeon 11/08, IME per WC 12/08. 01/09 WC ended benefits, their IME said my 2 EMG's neg, and my doctor charted that one was positive, so he and my primary doc misdiagnosed me, no carpal or cubital tunnel, likely fibromyalgia. My lawyer did a 19B?, hearings 02/09 and 03/09. Judge said do another IME, pay me WC benefits from Jan to now. Finally got a check this week!! Now job has sent me LTD forms and advised me to apply for SS disability. (sorry so long did not want to leave anything out) Should I apply for disability? Do they approve for my diagnoses? Job says no to part time and per American disability act committee, they do not have to find other work for me to do, is that true? Thanks for any response.

American disability act committee is correct, very correct.

One never knows what Social Security will award as disabilty, till one apply's and see what happens.

If in pain, why isn't your attorney fighting for you to switch doctor's or get a second medical opinion of your own?

Well my lawyer suggested the new IME doc and WC agreed to let me see him. is this the same as a second medical opinion. Prior to choosing my surgeon, I saw another doc whose dx was the same as my others, I just did not like his bedside manner. I forgot to tell you that my sx says I am at MMI. My FMLA is maxed out and the jobs occupational nurse says they will fill my position but my lawyer says they can not terminate me. So far i am still an active employee.
