Self pay - what to expect next....
Long story short - my Dad's employer is a self pay - we filed a WC death claim as my Dad passed from a work related disease. We have been to the IC twice and won both. The Commission level was denied. The employer have 60 days to file yet another appeal with the actual courts. Is this 60 calander day or 60 business days?

Do self pays normally just keep appealing and appealing thinking they will wear us down and we will run out of money to fight??

We were told by our Attorney that if we do go to court that the employer will try to settle before we go to trial.

Has anyone ever dealt with a self pay in this manner. Mom gets a check every 2 weeks for the rest of her life.....could be 20+ years....if they do try to lump sum it for us to go away - is there a formula they use or do they just pull a tiny figure out of their tush?

Any insight would be so helpful.

It shouldn't be costing you any out of pocket $$ for the other side to appeal. You should get an itemization of those costs and discuss them with your atty. you can appeal the charges to the work comp commission if you disagree.
every party comes up with their own figures to negotiate settlement; it really depends on the strength of their case.

I would assume that mrsoldnumber7 is from Lynchburg, Tennessee.Maybe a relative of Lem Mottlow (Jack Daniels)
