If it is the IC that pays the claim wether it be lump sum or carried out on weekly payments, Why would the ER not want the IC to lump sum? If the rates are affected, would'nt it be the same either way? Liability has been established and I was terminated from the company (because of the injury), so why is the ER even involved at this point?Also UA stated that earning wages would not affect the weekly payments, Why then have I read on this forum about people having their benefits reduced because of wages? I have read the state rules and regulations, but most of that is written in greek to me.Sorry for all the questions, but this is the place for answers.

Fencer, I'm in Pa, and Totally Disabled, so I can't Really give a Response on You Starting Your Own Business other than if You can wait until Your Case is Over, it wold be a lot Less Complicated for Everyone Involved. I Totally Understand Your Anger, it's been going on 5 Years Now, and I have been being Under Paid in the Amount of $200.00 per Week now, I won at the w/c Level, and Received Back Pay on $80.00 per Week, and now have to go to the Commonwealth Level, out of the w/c System to get the Rest. I Will Win, We have Case Law on Our Side, but that's the Way My Case went, and it's has taken forever just to get Here! I'm Angry also and Can Understand Why You would want Pay Back. Ace, it's not always as Easy as Throwing Payroll Receipts Around, I Wish it were, but each Case is Different, with Different Variables. I didn't go Crying for Food Stamps or Medical Cards Either, but I will SURELY get EVERY PENNY, plus Interest My Employer is Under Paying Me!! They are Playing a Loop Hole, and know I am Under Paid, and they don't Care if I can Make My Mortgage or not, or whether I Eat or Have Heat or Electricity, So I will Fight until I Win, which I know I Will! So My Humble Opinion would be to Keep it Simple for Your Attorney until Your Settled, and then I Agree with UA, I don't think they can Touch You Once Your Settled!!

Still, Thanks. My wife keeps telling me to tell my atty that we are sick of eating beans and rice, and I have told her a hundred times "they don't care". I sometimes also feel that my atty does not either, however, he knows my living situation and knows that we are surviving. I am fortunate to have an atty for a landlord (we live in one half of her house) on a farm where I am able to do some light building/barn maintenance, tractor work and other things that are within my restrictions. I don't get paid for doing this stuff, but we have not been evicted either. For the past year we have not been able to pay the rent that we should, and my landlord understands the whole situation.If not for her we would be living in a tent city and getting food stamps. I would rather leave the food stamps for the young mothers who don't have a spouse or better half to help them out. As bad as my life may seem, there is ALWAYS someone in much worst shape.

Very True Fencer, and You are a Good Soul to Think that Way! My Wife and I are getting by, Barely, and My Attorney knows this and Understands, but as He Said He can't Speed up the System, but will be there to Fight like He** when it's Our Turn!! It's been going on 5 Years for Me, and We are Still Fighting, and I know All too Well how it can Make Our Wives Inpatient! But that's not Their Fault, they are as Caught Up in this System as We are, because Our Outcome Affect Their Lives Also! We go to Work to Provide for Our Families, get Hurt, and not only Our Lives, but Our Families as Well have to Pay the Price of a Slow and Sometimes Very Unfair w/c System!! Hang in there Fencer, the Sun will Shine Again, just keep Sluggin' and Hopefully You'll Come Out the Winner on the Other End!!
