I had a foot injury on the job back in jan of 2007. I have reached MMI and also the 104 week limit of indemnity. I was also approved for vocational retraining which I am currently taking. Fortunatly for me my workers comp rep has been very helpful and cooperative I never missed a check and all my medcal bills (including 2 seperate surgerys) have all been paid for! Now that I no longer have a check comong in my rep asked me to consder settling my case with a lump sum to tide me over until I finish retraining. He said that the most workers comp pays out for a partial dissability is $25,000.00 and he was approved to give me $20,000.00. My doctor said I may need another surgery in the future. According to my comp rep my last 2 surgeries were only $5,000.00 each so medically I would be coming out ahead. In your opinion should I settle or do I need to hire an attorney to help me?

I have a slight limp and some pain but Im not one of those people who fake an injury During my times with the doctor he asked me how it felt and I pretty much said OK When I took the test to see what my impairement raiting would be I really did my best and in most tasks the lady made me stop! It just seems like some people I know who have settled before got alot more than that and I feel Im worse off than them.

Unfortunatley, WC settlements have nothing to do with pain and/or suffering.

There are several things that go into figuring a settlement. Such as, loss of mobility and loss of future wages.

Every claim is different. You may want to ask your dr. what the suries cost and not take the word of the WC rep. and another note. If you have to pay for a surgery, you are not going to get the same rate as WC does.

8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom.

Your case manager is not your friend. She works for the insurance company. I wouldnt settle without an attorney consultation.
