Unemployment Compensation after Settlement ?
hello,
In PA,I was wondering if anyone knows if after you recieve a settlement for your workers compensation case can you apply and recieve unemployment compensation ? I have heard you can but also heard you can't because the last employer you worked for settled with you on the workers comp case for a lump sum, being in construction i know work is very slow, any advise would be greatly appreciated

I'm from Pa. also, and If You have been Released by Your Dr. to Work, even with Restrictions, and You are Able and Available to Work, You should be Able to Sign for Unemployment. I don't Believe the Settlement has anything to do with it, Your Health and Availability to Work is the Guidelines for Unemployment. They are 2 Separate Entities w/c and Unemployment. It is possible. Your UC will be based upon the period before you went off for the work injury, so assuming you otherwise qualify, you can apply. If you settled your case and signed a resignation, your employer may argue that this was a voluntary quit, but you can show up at the hearing with the settlement docs and make a good case that the reason why you quit was to get the settlement and that this would be reason of necessitous and compelling nature.
