Rolleyes I am from Upstate, NY. I tore my rotator cuff (L) 3.5" at work in front of all.
Cashier 4 yrs, injury 6/26/2005.
Had my SSD hearing yesterday, Had health problems prior & restrictions. WC Case dropped my case one month after surgical failure. Many had dropped the ball on this case. I wish to report some of these actions so they are not repeated. Every one states no one is in charge of this including Lawyer. I want to know who is the oversite person or committee in NYS. Here are a few tidbits.
When injured, HRM refused to send in injury form to employer headquarters, sent Heart Attack. The next day I brought in DRS out of work slip, for shoulder injury My worker's comp claim was automatically contested. (no heart attack).
Waited from 6/05 to 10/05 for ortho appt. Ortho can decline on any contested WC caim.
Took from 7/05/05 to 2/06 for MRI approval, 3 doctors requested.
This was after 3 hearings & retained lawyer;(9/05), & IME visit.
Took until 4/21/2006 for surgical proceedure, with medical prompts.
P/T CXL'D 3x's d/t lack of insurance payments, still have hundreds of dollars of ins covered services on credit report.
Total hearings 9. Case closed 1 year after surgery & one month after confirmed surgical failure. Lawyer quit 4 months later.
The rest is just too long to list, all similar. I thought it was lieutenant governor, thought wrong. Someone needs to be responible. Please point me in correct direction. We can't stop it by keeping quiet.

Have you contacted any other attorneys? He has helped me with a few questions. This forum is great for answers .. Its members are caring , loyal and informative. Another great website where you should beable to get alot of answers is http://community.lawyers.com/messageboar...eadId=3598 . A lawyer from Norwich NY is the board guide. Hes helped me out with a few questions. Good luck to you .

You are great person with great advice. This has been going on since 2005.
I had seen this page before but thougth it was about the NY Insurance Co that turned out to be just another ins. co. Even they could not help me. I am so glad that you were able to.
