|
I was injured due to a co-worker upset by throwing a box that hit me. Workers comp is taking care of the medical and is paying 2/3 of my salary. Is there anyway I can get the other 1/3 of my salary as the bills are piling up and my creditors are not helping. I tried the workers comp agency and my HR department, but said I am out of luck. I can see if I caused the injury, but that I lose 1/3 of my income due to the co-worker does not seem right. Any suggestions?

well you arent paying any taxes out of that 2/3 ...all you have left is to maybe sue your co worker and I am not sure you can do that many on here have been injured by co worker pranks....
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

You can Sue the Co-worker if they have any money and any Assets. You might have to find an Attorney to do this. But, any money you get, may have to go to pay WC back then.

I have heard that any money from a law suit would have to go to pay back w/c. But what Jayne says is something to think about...even though you get 2/3 of your pay, its tax free and most people pay the other 25-30 % in taxes. So, what you are getting now should be close to what you were bringing home after taxes (unless you were exempt from taxes. I was one that was exempt from taxes myself and so I can understand the loss of that 33% in income.) Also, look through some of the older posts...there have been some very creative suggestions as to how people have been making it on limited bugets.

As rough as it seems, if you are actually getting 2/3 of your salary you're lucky. In AZ you get 2/3 up to a cap, reguardless of how much you make there is a cap, so even maxxing out what we can get through WC its almost $1k a month less than what 2/3 of income would be.
The benefit being no taxes are taken out and you don't have to claim it as income. There are many circumstances but they have to establish some protocol and that is it. |

Any suggestions?Hey, I have a friend that is here in florida and she went to the workmans comp judge and asked for the other 1/3 of her income but she had to prove she was the only one in the house makeing the money and paying bills. She had 3 kids. i dont know if that helped her but she did win the judge gave her 95% of her salary for 3 months. But that is just what she had told me. We have been friends for 11 years so i believe her. |

I know a person that recieved work comp checks he would sign them over to his employer and the employer would pay him his regular salary he was getting before the Injury.

I'd agree...unless you have SI joint problems. My mother in law has been an avid yoga student for years now and she had been having back problems but had not seen a Dr. yet. She went to a classes and did a move that brought on extreme pain. Her instructor gave her some less strenuous stretches to do & told her to see a Dr. Come to find out, she has an SI Joint disorder & when she told her instructor, she told my MIL to never do any of the poses that were not laying on her back. My MIL said that 85% of her class was not on their back and that meant she could not keep going to that class.
I do agree though, that for most cases it is a wonderful way to keep your body tone and fit. |
