Judge denied settlement offer. Question?
Hi,

I am new here. I know no one can answer for sure. But, what is the rule of thumb? Why did the Judge decline the settlement offer and request a "urgent hearing"? Offer to low or to high?

I do have an attorney. But, I think he is worthless. No payments in 2yrs! Then an offer comes in (low). I decline. I give what I would take. They decline. Then another offer for a few thousand more. I took it. Were were being foreclosed on, and had both our cars repo'd. No money in two years...geeez! Honestly, I think it should have been 3-4x the amount.

Without know more about your case its hard to say much but remember nobody gets rich from WC. It's not set up that way. Trust me my employer cut my pay back in April 2007 took til Nov 2008 to get a hearing and then til this Feb to get an anwser from that hearing. Now my employer has 30 days to appeal it. And if they do it could be a year or so to get an answer from that. If I didn't have a very understanding landlord I would be out of a house, and I'm driving a 20 year old car. Well it's broke down right now so I don't have a working car right now. But I know in the end I will never even get back the income I lost let alone my health.
In your case it does sound like the judge could be looking out for you. Remember he doesn't care how bad you need cash, just wants to see you get a fair deal.

I hope you get what you want, but you must also think about whats in front of you. Are you still injured and will you be recieving future moneys. By what you said, No money in 2 years, I dont know what you were doing when you got hurt but 2 years without ttd payments could amount to quite a lump sum of money.

But we dont know any of your specifics, Like what happened and are you at mmi any restrictions do you still need medical treatments. Like others have said you will not get rich of WC but get what you deserve.......... Take care and good luck.

dont take a settlement without a lawyer

Jeep, Some Times what We feel Our Case is worth is a lot More than it Actually is. Here in Pa., We have the Ability to Negotiate Our Settlements, but there is also a Term Used called a "Glass Ceiling" which Means that there is only so Much a Case is Worth. Sure the Ceiling can in some Cases be Cracked or Broken, but it also Works the Other Way, if We keep asking for Settlements Well above the Glass Ceiling the Ins. Co. will Stop Negotiations and try and Figure a Way to Beat You Out of All of Your Money. You need to Search for Other Cases that are close to Yours that have Settled, and See what the Average Settlement Amount for that is. Then You will have a Pretty Good Idea of where You Stand, and I do Agree with 1171, Judges don't Usually turn down Settlements that are too High, so You were Probably Low Balled and Your Attorney either just wants to Close Your Case, or Doesn't Care and will take any Settlement for Quick Cash! You have a Rough Road ahead, You need to Set Down with Your Attorney and Make Sure the Both of You are in the Same Ball Park. If not, it Maybe Time to Look for another! Best of Luck!!Wink
