Here's my story. I hurt my back at work on 10/07/2008 in phoenix, AZ. Workers comp paperwork filled out, went to doc. did everything i was supposed to. I just recieved my first wc check yesterday and it not even close to what i was expecting to get. Called my claims lady and was told that wc is based on money earned while injured. The last pay check i recieved from my company ended 10/10/2008 3 days after i had been hurt. I was completely off of work for the last 3 days per docs orders. Claims lady says that because the paycheck was issued while I was injured that money is used to calculate my wc. Can someonee please explain to me how money i earned prior to being injured counts as money earned while injured?

It sounds like they made a mistake, I know they take your most recent wage. Call your employer and ask them to look into it after all they pay for the insurance. Did they consider just that week or an average. Someone else will be along and maybe answer your question more. |

I know with me, they calculated my benefit by using the prior 4 weeks of work, I might be wrong....it could have been six. But I am thinking that it was four. Unfortunately during that time my employer had a few days off to her mothers, so I wasn't working. It wasn't a usual four weeks, but that made no difference to w/c. So unfortunately I had to accept what they gave me. They did say that if I could provide payslips for the entire year they could calulate on that, but when I checked it would have probably worked out worse since again, my employer took the entire summer away to train her serviced dog. I was doing a lot of housekeeping to keep up wages, but this was all on the side, so that was not calulated either.

One pay check doesn't set your TTD check payments. The Insurance carrier uses a anywhere from a months pay to past 12 months pay to calculate your now TTD check of 66 and 2/3 your past Pay.

I'm not Sure about AZ., but in Pa., they Base it on the Highest 3 of Your Last 4 Quarters of Work, and Pay 66 2/3% of that Average because w/c is not Taxed. Some States such as Pa. have a Cap., I think Ours now is Somewhere around $720.00 per Week. My Opinion Only, I would Search for Your States Rules of w/c, and try and Find Out how they are Supposed to be Paying You. Then when You Call back You will be Better Prepared to Discuss this with them. Best of Luck!!

Okay i guess I said this wrong. They calculaed my mothly average at $4900 but AZ sets a cap at $3000. AZ pays wc every 30 days. My first 30 day check from wc had $2000.99 taken out because that was what my last paycheck from work was for. The pay period of that paycheck was 09/26/2008 thru 10/10/2008. I was injured on 10/07/2008. Why was money that i earned before i was hurt taken out of my wc check?

I'm not sure I am following you.
You received a paycheck for 9/26-10/10, right? Then you were injured on 10/7, right. So the pay period for your 1st WC check should only be for 3 days. Is that what it was for? dsny1mom |

They May have a Waiting Period before any benefits were Paid, and the Paycheck you Received May have Fell in that Period, so they Deducted it. I am not Sure on that, because I never had Funds Deducted other than Attorney Fees, and I'm in Pa., I just thought I would Venture a Guess. I Understand what You are Explaining, and it doesn't Sound Right. Did You Check the Tab on the Main Page of this Forum Titled "Info. by State"? For myself, here in VA, they take your average wae, from 52 weeks, prior to your injury. If there is a week that you did not work at all...then thy replace that weeks hrs. with those of the prior week.
