RE: need advice
wouldnt be to me but everyone is different....depends on what rating your Doc gives and then you have to factor in meds and are you gonna need another surgery ?are you gonna be able to work making the money you made before? as you see the questions can be endless.....I suggest if you have a lawyer you talk with him if not most wc lawyers will give you a free consult.......

;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....Smile

RE: need advice
Need more info. Was this surgery a cervical, thoracic or lumbar fusion? Will this settle the whole claim or will your medical be left open?

RE: need advice
it depends on what permanent restrictions your doctor places on you and what rating you are given.
wait until those are known before discussing settlement.

RE: need advice
Don't let your C/A push you into a settlement. It is their job to close as fast as possible. They don't care about you. If you are confused, now is the time to talk to an attorney.

Let Go, and Let God......

RE: need advice
That amount is too low IMO. Heck I was offered 6 figures for a permanent shoulder injury which we turned down.
Simple mathamatics until retirement age on wage loss, medications, doctor visits was much more than their offer.

RE: need advice
The first of the year is probably a write off for taxes. You said it was 6 yrs. and have a 10 yr. limit. That leaves you 4 left. You also need to figure in your age and how many more years you have left to work before retirement. Also need to know if the bills have been paid. There is still alot here and what does your future look like with having all this trouble with your back? That 62,000.00 would not go far if you need further surgery down the road, medication, PT/OT etc.

I would not rush into anything to settle just because they want to get it done in time for a tax write off.

carpal tunnel recurrence/ neuropathy / RSD.
1/29/07 injury date. Permanent. PIR settlement 8/4/08 10%
