I WANT TO THANK EVERYONE FOR THEIR IMPUT. BUT, I NEED MORE HELP. I AM LOOKING FOR CASE MATERIAL WICH MAY HAVE BEEN RULED ON PERTAINING TO MY JOB INJURIES AND PRE-EXISTING CONDITIONS PERTAINING TO BAD BACK AND BEING ON SSDI IN THE STATE OF ILLINOIS.
THE SAME TIME I RETURNED TO WORK I WAS STILL RECEIVING SSDI. AGAIN, I HAVE HAD 3 BACK OPERATIONS IN THE PAST. IN 2006 I TRIED RETURNING TO WORK AND WAS INJURED ON THE JOB, HAD ALL THE RUN AROUND, TAKING A BIT FROM ARLO GUTHERY I, WAS INFECTED, INJECTED, NEGLECTED, AND PUT AWAY WET. I WENT THROUGH ALL OF THE INSPECTIONS,X-RAYS, C.T. SCANS, E.M.G, TWO OPERATIONS FOR THE SPINAL CORD STIMULATOR , LEADS REPLACED. ALL OF THE WAITING, MAN I DON'T KNOW HOW MUCH MORE I CAN TAKE. I AM NOW 50 YRS OLD, FATHER OF 4, PA PA OF 3 ,STREET SMART, EDUCATED, FORMER LAW ENFORCEMENT OFFICER, INVESTIGATOR, ETC. I HAVE BEEN RELEASED FROM THE D.R. BACK IN 2007. I HAVE NEVER RECEIVED ANY TYPE OF PAYMENT FROM MY EMPLOYER/INSURANCE COMPANY, THEY REFUSE TO PAY FOR OR GIVE ME ANY WAGES SINCE THE ACCIDENT IN 2006. I NEED TO FIND ILLINOIS WORKMANS COMP RULING ON A PERSON ON SSDI AND TRIED RETURNING TO WORK WITH A PRE-EXSISTING MEDICAL CONDITION AS A BAD BACK WITH 3 OPERATIONS. I NEED TO KNOW HOW THEY RULED, WHAT FACTORS WERE TAKEN INTO PLACE, 2 OPERATIONS FOR THE SPINAL CORD STIMULATOR, NOT COUNTING THE TRIAL STIMULATOR. INSURANCE COMPANY REFUSING TO PAY A DIME THE WHOLE TIME. I ALSO NEED TO KNOW HOW TO ANSWER THE QUESTIONS IF THIS GOS TO COURT OR TRIAL. SINCE THIS STIMULATOR DOES NOT WORK FOR MY INJURIES IN THE BACK, BUT DOES SOME HELP WITH THE NERVE LEG PAIN. I WANT THIS THING OUT OF MY BODY,IT HURTS MY BACK WHERE IT IS, CONSTANT THROBING, BURNING, SWELLING OF THE AREA, REDNESS,VERY DISTURBING WHERE IT IS. BUT I AM AFRAID TO DO SO BECAUSE I DON'T KNOW IF THIS WOULD EFFECT MY CASE. I HAVE WAITED BASICALLY ABOUT 3 YRS SINCE THE ACCIDENT. OR SOULD I WAIT TILL THE CASE IS OVER AND THEN HAVE IT TAKEN OUT. Have you spoke to your local SS office? ours was a wealth of information.....
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

What You are Asking Us is to Explain Many Items that Only the SS Office and a Competent Attorney that Specializes in w/c can Answer. We Have a Wealth of Knowledge Here, and I'm Sure You will get some Replies, but My First Question to You would be: Did You Contact the SSA and Tell them You were going back to Work while Still Under SSDI? If so they Probably would have Enrolled You into the "Ticket to Work" Program, and if so, You would need to Contact that Section of SS. If You did not tell them You were Returning to Work, and Collected both SSDI and Paychecks, You May have a Pretty Bad Situation there. That's why it's Best, in My Opinion, as Complicated as Your Situation is that You go Right to the Source for Answers! I Hope Others will be able to Help You, and You get the Answers You are Looking for!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

Yes I did tell Social Security I returned to work and I was on the 9 month trial work period. I gave them copies of all of my paystubs every time I got paid. I informed them of my injury and that the employer let me go because I could not fullfill the duties given to me.
I even went so far as giving Social Security my Lawyers name ,address and telephone number. Every time I had work since the injury I again did all of the above. Is there case law of someone in my position who has had and (or) in the same situation I am in. I need to find this information. Harley- first off you need to talk with the SS office and then talk with your lawyer. Let him/her find the case law. If you do not have a lawyer then I would start talking to a few lawyers and then decide on the best lawyer. Do not pick a TV lawyer, as they are not very good. As for your pain and stimulator you need to talk with your doctors and tell them about the pain and how the stimulator makes you feel, they may need to make ajustment to the setting. In IL it takes a while to settle, ask you lawyer why you are not recieving TTD payments.
